Global Talent ILR after 3 years: when can your partner settle?

Accelerated settlement belongs to the applicant, not the household. Before a Global Talent holder applies for ILR, the partner’s permission history and the family’s next applications need a separate decision.

Current Rules and guidance · Checked 19 September 2026

The principal applicant’s accelerated route does not shorten the partner’s qualifying period.

This analysis addresses an existing family planning problem, not a newly introduced concession. It distinguishes the Rules from caseworker guidance and identifies the English language change already specified for settlement applications from 26 March 2027. Future policy proposals are not treated as current eligibility rules.

The position

A Global Talent partner normally needs 5 qualifying years, even if the main applicant settles after 3

A dependent partner does not inherit the Global Talent holder’s 3 year settlement period. The partner must complete their own continuous 5 year qualifying period and meet the remaining requirements. Earlier permission as the same person’s dependent partner may count. An eligible existing dependant can extend after the main applicant settles, so switching to a spouse visa is not automatically necessary.

  • The couple’s application dates need not match. An earlier arrival or qualifying route history can also mean the partner is ready when the principal settles.
  • Preserving an existing dependant route is different from bringing a new partner into that route after settlement.
  • Children require their own assessment; neither the principal’s 3 year period nor the partner’s 5 year requirement should simply be applied to them.

The endorsement decision often becomes the centre of a Global Talent strategy. Once it is secured, the family assumes the remaining task is to count 3 years. The problem emerges when the principal applicant prepares for settlement and the partner discovers that their own position is materially different.

This is not a reason to reject accelerated settlement. It is a reason to distinguish 3 decisions: when the principal should settle, how the partner will remain lawfully in the UK, and when the household can reach its intended long term position. A single expiry date on the family’s visas does not make those decisions identical.

For employers recruiting senior talent and advisers coordinating international relocation, the difference affects the budget, travel arrangements and the assurances that can responsibly be given to a family before a move.

01 · The separate tests

Start with 2 permission histories, not 1 anniversary.

Appendix Global Talent distinguishes the principal’s 3 or 5 year qualifying period in GT 11 from the partner’s 5 year period in GT 30.1. Eligibility for the principal’s shorter period depends on the endorsement or prize basis. It is not available to every Global Talent holder. The partner’s rule remains separate even where the principal unquestionably qualifies after 3 years.

An illustrative couple who enter together, with no earlier qualifying permission, will ordinarily reach the principal’s accelerated settlement point before the partner’s. If the partner joins 1 year later, the gap is greater. Conversely, earlier qualifying dependant residence can narrow it. The calendar must be derived from the grants and residence record, not the date of marriage, endorsement or an intended relocation.

The practical file should show the route, capacity, grant dates, actual entry, expiry and absences for each person. A partner who has lived in the UK for 5 years has not necessarily spent those years with the type of permission required for this settlement application.

02 · Earlier residence

A change of work route does not necessarily erase dependant time.

GT 30.1 focuses on permission as the dependent partner of the same person. The Home Office’s dependent family member guidance also recognises a last dependant grant in a different route. A period as that person’s Skilled Worker dependant can therefore be relevant when the principal moves to Global Talent. It should not be discarded merely because the route name changed.

That does not mean every form of lawful residence can be added together. Time held in the partner’s own capacity as a Student or worker is not automatically dependant time. The principal’s ability to combine specified work routes under GT 11.3 is not a rule allowing the partner to combine every visa they have held.

The guidance expressly discusses time as a spouse on family routes. Cases involving Appendix FM, a change of capacity or settlement on another basis need a provision-by-provision review of the qualifying history and the latest grant. Neither ‘every switch resets the clock’ nor ‘all lawful residence counts’ is a safe substitute for that exercise.

Where the principal changes route while the partner still holds unexpired dependant permission, check the continuing validity of that grant, the next application and the route on which settlement will be sought. Do not assume either an immediate mandatory switch or indefinite protection from a visa that will shortly expire.

03 · Continuing permission

Settlement by the principal does not require an automatic move to Appendix FM.

GT 16.2(d)(iii) and GT 19.1(c) provide for qualifying partners where the principal is settled or has become British. The principal’s Global Talent position when they settled and the applicant’s dependant status at that time matter. A genuine continuing relationship and the other requirements still need to be established; the principal’s ILR is not itself an extension for the partner.

For an eligible partner needing further permission after the principal’s Global Talent settlement, GT 24.1(b) specifies a 3 year grant. The caseworker guidance makes clear that a dependant cannot simply choose a shorter grant because less time remains before settlement. A family needing only a relatively short bridge should budget against the required grant, including the applicable application fee and Immigration Health Surcharge, rather than an assumed monthly extension.

Obtain the principal’s settlement decision and the partner’s permission record together. Record the next filing deadline independently of the principal’s completed application. A family can otherwise treat settlement as the end of the process while a dependant’s expiry is still approaching.

04 · The sequencing risk

A partner who has not entered the dependant route presents a different problem.

An existing dependant seeking to continue is not in the same position as a partner who first wishes to join after the principal has settled. The continuation provisions require the relevant prior status. Marriage to a former Global Talent holder does not, on its own, create a new Global Talent dependant route after settlement.

This deserves attention where the partner remains overseas, holds permission in their own right, or has postponed their application for professional or family reasons. Before the principal files for ILR, decide whether the partner’s intended route is available on the proposed sequence. Merely submitting a dependant application should not be assumed to establish the permission required at the time of settlement.

The answer may be a coordinated sequence while the principal still holds Global Talent permission, or an assessment under a different route with its own financial, relationship and settlement requirements. This is a case-specific choice, not a recommendation to delay ILR indiscriminately. The costs and risks of postponement must be considered alongside the family benefit.

05 · Substantive eligibility

Five years on paper is not the complete settlement case.

GT 31.1 applies Appendix Continuous Residence to the partner. The ordinary absence limit is 180 days in any 12 month period, subject to the applicable exceptions and transitional treatment. The Home Office guidance excludes absences during dependant permission granted under the Rules in place before 11 January 2018 from that calculation. Historic cases need the actual grant record, not simply the travel dates.

Prepare a separate travel schedule for the partner. Do not assume that a conclusion reached for the principal automatically resolves the partner’s case, particularly where the principal relies on a specialist research provision. Classify any claimed exception under the applicable text and retain evidence of the reason for absence. An employer’s willingness to permit overseas work does not itself determine immigration residence.

The settlement assessment also includes suitability, the continuing relationship, English language and Life in the UK requirements, with applicable exemptions. GT 32.1 currently specifies B1 speaking and listening for applications before 26 March 2027 and B2 from that date. A family extending now towards a later settlement application should plan against the requirement applicable when that application is made. This is a dated provision in the Rules, not a prediction about a future policy announcement.

06 · The household decision

A child’s position may follow neither adult’s timetable.

The partner’s 5 year qualifying period should not be imposed on a dependent child. The child instead requires assessment under the route’s child provisions and Appendix Children. CHI 4.3 generally requires the other parent to be settled, British or settling at the same time, subject to specified exceptions including sole responsibility, a sole surviving parent and serious and compelling reasons.

The consequence can be counterintuitive: a child may not need 5 years of their own residence but may still be unable to settle alongside the principal because of the other parent’s position. The relevant exception must be established on the actual family facts, not inferred from one parent earning more or handling the immigration paperwork.

For children born in the UK, nationality is a separate question worth reviewing when a parent settles. This article does not replace that assessment. Record the place of birth, each parent’s status and the child’s existing permission before choosing between continued dependant permission, settlement and any available nationality application.

07 · Implementation

Give the family a schedule of decisions, not a single settlement promise.

A useful written plan identifies what happens if the principal’s settlement is granted, delayed or refused; when each dependant must apply; which residence periods are relied upon; and which documents remain outstanding. It should identify the person responsible for each deadline. These are recommended planning controls, not additional conditions in the Immigration Rules.

For a corporate relocation, separate the immigration advice from the employer’s financial commitments. Confirm whether the relocation package covers dependant extensions, the associated surcharge, settlement applications and advice on the family’s differing dates. An offer described as covering ‘the visa’ can leave substantial uncertainty once the principal settles early.

For a private client household, test proposed overseas assignments and school plans against the partner’s remaining residence period before commitments are made. The commercial freedom of the principal’s new status should not obscure the restrictions still affecting another family member.

Family settlement decision framework

Resolve the sequence before submitting the principal’s application.

The aim is to identify the earliest defensible settlement date for each person while preserving the permission needed to get there.

01

Establish the principal’s basis

Confirm the endorsement or prize category, qualifying work route history and the actual settlement requirements.

02

Reconstruct the partner’s record

Separate dependant permission from permission in their own right and identify which periods relate to the same principal.

03

Check the status at settlement

Distinguish an existing dependant continuing the route from a partner who has not yet obtained the relevant permission.

04

Test the bridge

Identify expiry dates, extension eligibility, the prescribed grant period, fees and any planned travel.

05

Review each child separately

Apply the parental status and child requirements, and examine nationality where relevant.

Practical questions.

Can my partner obtain ILR after 3 years because I have Global Talent?

Not merely on that basis. The dependent partner normally needs their own 5 year qualifying period. Earlier qualifying permission may mean they have already completed it when you settle.

Does Skilled Worker dependant time count after a move to Global Talent?

It can count where it was qualifying permission as the same person’s dependent partner. The complete history, latest grant, residence and route requirements must still be checked.

Must my partner switch to a spouse visa when I obtain ILR?

Not automatically. The Global Talent Rules allow qualifying existing dependants to continue after the principal settles or becomes British. A different route should be chosen only after assessing eligibility and the settlement consequences.

Can my partner request only 1 more year of dependant permission?

Where GT 24.1(b) applies after the principal’s Global Talent settlement, the specified grant is 3 years. The guidance does not allow the applicant to choose a shorter grant simply because settlement may be reached sooner.

The strongest family strategy preserves the benefit of accelerated settlement without treating the principal’s success as an answer to everyone else’s status. The decisive work is often done before the first ILR application is filed.

Move from achievement to the proposition the evidence must prove.

Field, standard, attribution, independent recognition and impact must align. The route should be tested against the applicant's actual work before the evidence pack is fixed.
