Does exceptional assurance count towards 10 year long residence ILR?

A Home Office assurance that a person would not be treated as an overstayer did not necessarily extend their permission. For long residence, the distinction can preserve an immigration history while postponing the date on which settlement becomes available.

Current Rules and guidance checked 19 October 2026

Continuity can survive a period which does not contribute to the 10 years.

This analysis concerns a present application under Appendix Long Residence. It distinguishes the expired COVID concessions; it does not announce a new concession or assume that today's rules determine the legality of an earlier refusal.

The position

Exceptional assurance does not itself add qualifying time for long residence settlement

No. Time covered only by exceptional assurance between 1 September 2020 and 28 February 2023 does not count towards the 10 year qualifying period for long residence ILR. It was not immigration permission. A covered period can nevertheless be disregarded for overstaying and preserve continuity. Do not apply that answer to every COVID concession: qualifying permission extended under the earlier Coronavirus Extension Concession and the applicable August 2020 grace period are treated differently. Establish the legal basis and dates of each period before calculating when to apply.

  • A request for exceptional assurance was not an application which automatically extended permission under section 3C.
  • Exclude only time which lacks a separate qualifying basis: an assurance email does not erase valid qualifying permission held on the same dates.
  • A pandemic-related absence from the UK raises a separate absence question; it is not the same as exceptional assurance while in the UK.

The difficult document is often reassuring. It says that the recipient will not be considered an overstayer until a specified date. Years later, that email is placed between 2 grants of permission and the whole sequence is described as continuous lawful residence. The problem is not necessarily the continuity. It is the credit claimed for the intervening days.

For someone approaching settlement after studying and working in the UK, a small classification error can change the immediate strategy. The person may need a further period of qualifying permission, not a new 10 year history. Alternatively, records may establish that the supposed assurance period was actually covered by section 3C leave. Neither conclusion can safely be reached from the label COVID extension.

The useful exercise is to produce 2 conclusions from the same chronology: whether the chain survives, and how much qualifying residence it contains. Keeping them separate makes the application date auditable and identifies what further advice or evidence is needed.

01 / Separate the tests

Disregarding overstaying does not convert it into permission.

LR 11.1 requires a qualifying period of 10 years lawfully in the UK. LR 11.2 excludes specified periods of overstaying even where the Exceptions for overstayers apply. LR 12.1 separately imports Appendix Continuous Residence. A history must satisfy both requirements; success on continuity cannot replace the qualifying total.

Part Suitability, SUI 13.1(e), deals with overstaying between 1 September 2020 and 28 February 2023 covered by exceptional assurance. SUI 13.2 defines the assurance by reference to a written Home Office notice and the period it specifies. The whole pandemic is not a single protected interval for everyone who remained in the country.

The current continuous residence guidance expressly says that time under exceptional assurance does not break continuity but does not count towards the qualifying period. For example, a verified 90 day interval covered only by assurance is not credited merely because it sits between qualifying grants. If that is the only deficit and continuity is intact, 90 further qualifying days are needed. That illustration is not an application-date calculation: all other periods and requirements still need checking.

02 / Identify the concession

The August 2020 grace period is not exceptional assurance.

The Home Office distinguishes the Coronavirus Extension Concession, operating from 24 January to 31 July 2020, its August grace period, and exceptional assurance from 1 September 2020. The first concession extended permission in the circumstances described by the guidance. Exceptional assurance, including short-term assurance, did not grant permission. The names should not be used interchangeably.

CR 2.1(d), CR 4.1(d)(v) and CR 4.3 specifically recognise qualifying August 2020 time without permission as lawful presence where the required immediately preceding permission existed. The long residence guidance confirms that extensions under the earlier concession and the applicable grace period count. This is a specific provision, not a general power to count all pandemic overstaying.

Check the original expiry date, the person's location and the relevant concession before assigning credit. A gap which began before the concession is not automatically cured by it. Nor should an extension of an excluded route be assumed to turn that route into qualifying long residence. The route exclusions and the concession must be read together.

03 / Test the alternative basis

A timely immigration application and an assurance request do different work.

Section 3C can extend existing leave when an in-time application to vary it remains undecided at expiry, subject to the statutory conditions and validity rules. It can therefore explain lawful permission between 2 grant documents. An exceptional assurance request does not perform that function, and applying for a visa during assurance does not create section 3C leave if the person's permission has already expired.

Where both processes appear in the file, establish which one governed each day. Obtain the actual visa application submission record, validity correspondence and decision, not just the assurance email. An adviser who deducts every date mentioned in an assurance notice may undercount qualifying residence if permission independently continued. An adviser who counts every pending application may make the opposite error.

The category of permission being extended also matters. Section 3C continues the relevant leave; it does not make an excluded category eligible for long residence. The later grant date alone is therefore an unreliable starting point for measuring a gap, just as a pending-application acknowledgement alone is insufficient proof that there was no gap.

04 / Reconstruct the evidence

The missing request email may matter as much as the grant notice.

The concession guidance treats the interval between an assurance request and its subsequent grant as assurance from the request date. That instruction matters where the approval arrived after permission expired. It does not say that every unanswered or refused request established assurance, and it does not convert the interval into qualifying permission.

Build the record from the sent request, delivery or acknowledgement evidence, the Home Office response and every renewal. Record the requested period separately from the period actually covered. If dates conflict, preserve the original correspondence and identify the discrepancy rather than silently selecting the more favourable date.

For consecutive assurances, test the joins. The expiry of one notice and the start of the next may leave an interval requiring separate analysis, including whether the guidance on a subsequently granted request applies. Time after the final assurance ended is not protected simply because a later visa application succeeded. Current permission cannot be used as a substitute for investigating the earlier gap.

A subject access response can help recover missing records, but it is evidence to reconcile, not a legal conclusion. A concise schedule should cross refer each date to its document and state what remains unproved. Where an application deadline is approaching, obtaining records and protecting present status must be planned together.

Permission

Record the route, commencement and expiry of the grant, plus any verified statutory extension.

Assurance

Record the request date, grant date, covered dates and the notice supporting each renewal.

Classification

Mark each interval as qualifying, assurance only, another disregarded gap, excluded permission or unresolved.

Consequence

Give separate answers for qualifying credit, continuity and any current status risk.

05 / Keep travel separate

Departure during assurance requires its own analysis.

The continuous residence guidance addresses departure with exceptional assurance. For CR 4.1(d)(ii) and (iii), it treats a person as if they had permission on departure where they had permission before the assurance. It nevertheless excludes assurance time, in or outside the UK, from qualifying credit and treats time abroad as an absence. This is a limited continuity instruction, not a retrospective visa grant.

Separately, CR 3.4(b) provides an absence exception for travel disruption caused by a pandemic. Evidence of cancelled travel, border restrictions and the actual obstacle to return belongs in that analysis. A general reference to COVID does not establish why a particular absence occurred or how long the disruption lasted.

Keep a travel schedule alongside the status schedule. The first explains where the person was and why; the second explains their legal position. An absence exception should not be used as an unexplained substitute for missing permission. The interaction with return permission and the applicable absence limits must still be tested.

06 / Decide when to apply

Calculate the shortfall before committing to the settlement application.

The conclusion should identify a supported qualifying date and the assumptions on which it depends. Do not simply add the length of every assurance email to the 10th anniversary of arrival: notices may overlap permission, some days may fall outside the proposed qualifying period, and a separate break may invalidate the calculation altogether.

CR 1.1 allows counting back from the most beneficial of the application date, a date up to 28 days afterwards or the decision date. The long residence guidance addresses early applications, including refusal where consideration occurs more than 28 days before qualification. A filing strategy should not depend on an uncertain processing delay curing a known shortfall.

Check present permission and LR 11.3's requirement generally to have held the current route for 12 months at application, subject to LR 11.4's exception for current permission granted before 11 April 2024. Meeting the residence total does not dispense with the remaining eligibility, suitability, English language and Knowledge of Life requirements.

If further qualifying time is needed, the immediate question is how permission will be maintained lawfully while it accrues. Compare the actual available routes and their timing rather than treating an early ILR application as a holding device. Work, travel and dependant arrangements should be considered before the household commits to a settlement timetable.

07 / Identify the dispute

A past refusal needs the rules and record applicable to that decision.

This article explains the present Appendix Long Residence position. An earlier application or refusal may engage a different version of the Rules, transitional provisions or a specific representation made by the Home Office. Do not use a current summary as a substitute for examining those materials, particularly where a challenge alleges reliance on an assurance letter.

Distinguish a factual dispute over the covered dates from a legal dispute over their treatment. If the Home Office missed a qualifying statutory extension, the answer may lie in the application record. If assurance alone leaves a genuine shortfall under the applicable rules, producing the same letter again does not itself resolve it. Any proposed challenge needs a defined error, an available remedy and protection of the relevant deadline.

Long residence assurance audit

Produce a qualifying calculation, not a bundle of reassuring emails.

Use these controls to identify what the evidence establishes before deciding on an application or challenge.

01

Identify the governing regime

Separate the early extension concession, August grace period, exceptional assurance and ordinary permission.

02

Reconcile the documents

Match grants, applications, assurance requests, notices, renewals and travel to precise dates.

03

Test continuity independently

Explain why each non-qualifying interval does or does not break the chain.

04

Calculate qualifying credit

Remove assurance-only time without subtracting days already covered by a separate qualifying basis.

05

Control the next decision

Check the qualifying date, current route requirement, permission expiry and any remedy deadline together.

Practical questions.

Does exceptional assurance restart the 10 year clock?

A covered assurance period can preserve continuity without counting towards the qualifying total. That does not necessarily require starting again, but adjoining gaps, travel and the rest of the history must be checked.

Does the August 2020 grace period count for long residence?

The applicable grace period can count under the specific Appendix Continuous Residence provisions. Establish the immediately preceding permission and relevant dates; do not treat it as identical to later exceptional assurance.

Does applying during exceptional assurance give section 3C leave?

Not merely because assurance was in place. Section 3C depends on the statutory conditions for extending existing leave, including an in-time application. Assurance itself was not leave to extend.

What if the Home Office granted assurance after my visa expired?

The guidance treats the period between a request and its subsequent grant as assurance from the request date. Retain both records. This affects protection for the interval, not qualifying residence credit.

Can I rely on an old assurance email for my settlement date?

It is an important source document, but the calculation needs the full permission, application, assurance and travel history. Its wording should be analysed alongside the rules applicable to the application or decision in question.

The assurance letter should be given its proper effect, neither more nor less. It may protect the continuity of a valuable residence history without supplying the days needed for settlement. The correct next step follows from a verified calculation which distinguishes that protection from permission, identifies the genuine shortfall and preserves the person's present position.

Classify the decision, preserve the remedy and protect the objective.

A refusal, status problem or enforcement step should be analysed before a challenge or repeat application is chosen. Procedure, evidence and timing must be controlled together.
