UK self sponsorship

Not a visa route.
A regulated structure.

Self sponsorship is a convenient description, not an immigration category. The structure works only where a genuine UK organisation can obtain and operate a sponsor licence, offer a real eligible job and sponsor a founder who independently meets the Skilled Worker requirements.

Review the position ↗︎
Structure 01A genuine UK organisation

The company must be operating or credibly capable of operating in the UK, with lawful activity, appropriate evidence and a real commercial reason for the proposed recruitment.

Structure 02A compliant sponsor licence

Key personnel, HR systems, reporting, records and sponsor control must work in practice before and after approval.

Structure 03A genuine eligible role

Duties, skill level, occupation code, salary, hours and the stage of the business must support a vacancy that exists independently of the desired immigration outcome.

Structure 04An eligible worker

The founder must meet the Skilled Worker validity, suitability, points, English and financial requirements that apply to any sponsored applicant.

Founder control does not displace the need for independent evidence.

01

Incorporation is not business substance.

A newly formed company can potentially qualify, but registration alone says little about lawful activity, funding, premises, trading capability, customers, governance or the need to recruit.

02

Ownership is not the vacancy.

The role must be derived from the business and its present requirements. A generic senior title built around the founder’s CV can weaken both the sponsor licence and worker applications.

03

Sponsor control must be real.

The organisation needs suitable key personnel and operating systems capable of monitoring and reporting on a sponsored founder. Documents produced only for the application do not create compliance.

04

The structure must remain true after grant.

Salary, duties, hours, work location, company ownership and trading circumstances may change. The sponsor must recognise which changes require reporting or a new application.

Build the company case before the worker case.

The sequence matters. Promising a sponsored outcome before the business, licence and role have been tested can create commercial commitments the immigration structure cannot support.

  1. 01
    Compare the routes

Test Skilled Worker sponsorship against Innovator Founder, Global Talent, expansion routes and any personal category before ownership and governance are fixed.

  2. 02
    Establish company substance

Map ownership, funding, UK presence, trading activity, contracts, operating plan, regulatory position and the commercial timetable.

  3. 03
    Design sponsor control

Select suitable key personnel and establish right-to-work, reporting, absence, contact, record-keeping and change-escalation systems.

  4. 04
    Prove the role

Derive duties, seniority, occupation code, salary, hours and reporting lines from what the business genuinely needs at its present stage.

  5. 05
    Coordinate licence and visa

Control supporting evidence, priority timing, Certificate of Sponsorship strategy, worker eligibility and the continuing sponsor record.

The commercial facts determine the architecture.

A founder establishing a new UK venture, an overseas company entering the market and an existing UK business sponsoring an owner raise different questions.

Selling the business before settlement

The label obscures 4 separate tests. The analysis examines company substance, sponsor capability, the genuine vacancy and the founder’s own Skilled Worker application as a connected sequence of independent tests.

Direct answers. Fact-specific consequences.

01Is there a self sponsorship visa in the UK?+

No. The expression usually describes a UK organisation sponsoring its founder or owner under an existing sponsored work route, most commonly Skilled Worker.

02Can a founder own all of the sponsoring company?+

Ownership is not an automatic prohibition under the published rules. The company must nevertheless be genuine, the licence must be properly controlled, the vacancy must be real and eligible, and the worker must satisfy the route.

03Can a new UK company obtain a sponsor licence?+

Potentially. A new business requires particularly clear evidence of its UK presence, lawful activity, funding, operating plan, recruitment rationale, key personnel and ability to meet sponsor duties.

04Does the company need to be trading before it applies?+

The answer depends on the organisation and evidence. The sponsor must be genuine and operating lawfully or, in appropriate circumstances, credibly capable of operating. A dormant shell with no coherent UK activity or recruitment need will create material difficulty.

05Who should act as Authorising Officer?+

The Authorising Officer must satisfy the sponsor guidance and hold genuine responsibility for recruitment and sponsor compliance. Suitability, UK presence, employment status and the practical ability to supervise the licence require early review.

06Does a sponsor licence guarantee the founder’s visa?+

No. The licence, occupation code, genuine vacancy, salary, Certificate of Sponsorship and worker eligibility remain separate requirements. The Home Office can scrutinise each stage.

07Can dividends count towards the founder’s Skilled Worker salary?+

No. Dividends are shareholder distributions rather than guaranteed basic gross employment pay. The company must separately pay the qualifying Skilled Worker salary and maintain a coherent payroll and banking record.
