Citizenship is not an automatic final form after settlement. Naturalisation is a statutory and discretionary decision requiring careful analysis of residence, status, absences, character and the applicant’s nationality history.

01 / The approach

Establish the correct statutory route.

Naturalisation and registration are distinct. Eligibility can depend on age, birth, parents, residence, marriage, existing nationality status and historic law. The application form should follow the legal basis, not substitute for it.

Reconstruct residence before counting absences.

The qualifying period, physical presence at its beginning, absence limits and freedom from immigration restrictions need to be tested using an accurate travel and status chronology.

Address good character directly.

Criminality, immigration history, financial conduct, deception and other matters can be relevant. The current guidance and all material facts should be considered before deciding how and when to apply.

Questions before proceeding.

Must I wait 12 months after ILR?

Many applicants must have been free from immigration time restrictions for 12 months. A person married to a British citizen can be subject to a different statutory framework. The complete requirements still apply.

Is British citizenship automatic after settlement?

No. Naturalisation requires a separate application and is discretionary even where the statutory requirements appear to be met.

Do previous immigration problems matter?

They can. Lawful residence, breaches, deception and illegal entry can affect eligibility or the good-character assessment. Current guidance and the precise history must be reviewed.

Can a child register as British?

Potentially. Several statutory routes exist and some applications involve discretion. The child’s place and date of birth, parents’ status and later circumstances are central.
