Settlement should be audited before it is applied for. Route, qualifying residence, absences, status history, sponsorship or endorsement and knowledge requirements must be tested against the correct rules.

Identify which periods actually qualify.

Different settlement routes treat qualifying residence, combinations of permission and dependant time differently. A chronology should be constructed from grants, applications, travel and any gaps rather than assuming that time physically in the UK is sufficient.

Audit absences against the applicable framework.

Absence rules can depend on the route and period being assessed. Travel records, work reasons and exceptional circumstances should be reconstructed well before the intended application date.

Check the position that must exist on the application date.

Some routes require continuing sponsorship, salary, endorsement or relationship evidence. Settlement is not simply a historic residence test; current eligibility and suitability remain important.

Questions before proceeding.

Is ILR always available after 5 years?

No. The qualifying period and conditions depend on the route. Some routes offer shorter periods, some use 10 years, and some permissions do not lead to settlement.

Can different visa categories be combined?

Only where the relevant settlement rules permit combination. Long-residence analysis is different from settlement under a specific work, talent, founder or family route.

Do absences automatically break continuous residence?

Not necessarily, but the amount, timing and reason for absences must be assessed under the rules applying to the route and period.

Can family members settle at different times?

Yes, and this is common. Dependency, route history, age and qualifying residence can produce different timelines within one household.
