Three questions to settle before action.

Identify the licensed employer and operating model.

The brand, premises operator, payroll entity and proposed sponsor may not be the same legal person. The application should identify who employs the worker, which locations it controls and how responsibility is exercised across the business.

Test the vacancy against the current occupation rules.

A familiar job title does not establish sponsorship eligibility. Duties, skill level, working hours, salary and the current occupation tables must be analysed for the real role at the intended date of sponsorship.

Build controls for a high-turnover, multi-site environment.

Shift work, variable hours, seasonal demand, agency labour and movement between sites can expose gaps in right-to-work, attendance, pay and reporting records. The sponsor system must follow operational reality.

Questions to answer before the process begins.

01Can a restaurant or hotel obtain a sponsor licence?+

Potentially. The organisation must be genuine and operating lawfully in the UK, meet the sponsor suitability requirements and show that it can discharge its duties. Each proposed role and worker must separately qualify.

02Can chefs still be sponsored?+

Only where the actual role falls within an eligible occupation and meets the rules in force at the relevant date, including skill and salary requirements. Job title alone is not determinative.

03Can one licence cover several hospitality sites?+

Potentially, depending on the legal entities and licence structure. Branches, linked entities and separate employing companies should be mapped before the application or any restructuring.

04What happens if the restaurant operator changes?+

A sponsor licence is not transferable. A change of legal employer, ownership or operating structure can require reporting, a new licence and action for sponsored workers. The transaction should be reviewed before completion.
