10 year ILR: long residence, earned settlement and what your lawyer can actually do

The existing Long Residence route, a 10 year family or private-life pathway and the announced earned-settlement default answer different legal questions. Confusing them can lose qualifying time. Good representation improves the legal and evidential case; it does not buy a preferential decision.

Current Rules and announced reform · Checked 6 November 2026

Long Residence remains available now; the Government intends to close it.

Chapter 4 of the 2 November response announces closure under earned settlement. As at this review, Appendix Long Residence remains in the consolidated Rules. No universal closing date or blanket saving is assumed.

The position

Can I still apply for ILR after 10 years in the UK?

Potentially. Appendix Long Residence currently permits settlement after 10 years of qualifying lawful, continuous residence, subject to its other requirements. The November earned-settlement response announces that this separate route will close, but that announcement has not itself removed it. A lawyer should establish your present eligibility and change exposure. Representation cannot obtain preferential treatment or guarantee that a future reform will spare your case.

  • 10 years physically present is not necessarily 10 qualifying years.
  • A family or private-life 10 year pathway is not Appendix Long Residence.
  • Do not assume an early application reserves a future settlement entitlement.

A person who first arrived as a student may describe themselves as being on the 10 year route even though they have never held Long Residence permission. Another person may hold family permission expressly granted on a 10 year pathway. A third may be asking about the Government's new 10 year default. Before advice on timing or discretion is useful, that ambiguity must be resolved.

This article concerns the route-choice and instruction decision after the November response. The existing UKIC long-residence analysis explains absences, gaps and remedies in depth. This piece does not replace that technical framework or offer a second version of the same calculation guide.

01 / Identify the route

The number 10 does not identify the legal test.

Appendix Long Residence assesses a qualifying history across permitted categories. A person may be able to combine Student, Graduate, work and other eligible permission, even though some of those categories do not themselves offer settlement. Specified exclusions remain important. There is no automatic grant merely because an arrival anniversary has passed.

Family and private-life settlement use their own permissions, qualifying periods and substantive requirements. A 10 year family grant does not mean that every earlier year under any category counts towards that particular pathway. Equally, holding family permission does not prevent an independent Long Residence assessment where its requirements can be met. Establish the actual decision and route, not the client's shorthand.

The announced earned-settlement default is a third framework. Its intended 10 year period is not simply a renamed version of Long Residence. The response says the separate Long Residence route will close and temporary categories such as Student and Graduate will cease to build qualifying settlement residence under that model. A history useful today may therefore have a different future value.

02 / Present eligibility

Commission a chronology before deciding to apply or wait.

The starting bundle should include passports, every grant and refusal, application submission evidence, review or appeal papers, Home Office correspondence and a complete travel schedule. Reconcile the dates with records rather than relying on visa vignettes alone. In-time applications and section 3C can be material; an unexplained interval should not be labelled lawful or unlawful without checking what happened.

LR 11.3 separately requires at least 12 months on the current immigration route at application, subject to LR 11.4 where current permission was granted before 11 April 2024. Completing the overall residence period does not automatically satisfy that present-route test. A recent switch can therefore change the appropriate application date even where the historic calculation is sound.

English, Life in the UK and suitability need their own review. The current consolidated provision already changes the ordinary Long Residence English threshold from B1 to B2 for applications on or after 26 March 2027, subject to exemptions. That is a specific published application-date requirement. It should not be conflated with an assumed commencement date for the wider earned-settlement model.

03 / Timing

A lawful application window is not a reform reservation system.

Appendix Continuous Residence and the Long Residence caseworker guidance address qualifying-period calculation and the limited 28 day approach. They do not create a general right to file months early and wait for an anniversary. The guidance directs refusal where a case is considered more than 28 days before the required qualifying period is completed. A hoped-for processing delay is not a safe application strategy.

If the complete case is ready, assess a timely application under the Rules which apply, including any current expiry and the consequences of travel. If it is not ready, preserve lawful permission through an appropriate available route. The announcement does not extend a visa, authorise work or excuse overstaying while the person waits to reach 10 years.

Nor does submitting now necessarily protect a pending case from later amendments. The future Statement of Changes may distinguish application dates, decision dates, particular cohorts or specified grants. Until that wording exists, neither a blanket assurance of protection nor a fabricated last application date is justified. An adviser should identify this uncertainty in writing.

04 / Representation

Better representations are not preferential treatment.

A lawyer's task is to identify the applicable test, assemble reliable evidence and explain why it is satisfied. Where an express exception or discretion exists, the submission should identify its legal basis and establish its facts. Compassionate language, a long residence narrative or the firm's reputation cannot replace an unmet mandatory requirement.

For a difficult history, that work may involve distinguishing a period which does not count from an event which breaks continuity, reconstructing a pending application, explaining inconsistent records or obtaining evidence of the actual reason for an absence. The advantage is disciplined analysis and presentation. It is not a privileged relationship with the decision maker.

Quastels cannot promise preferential decisions, guaranteed discretion or an outcome unavailable under the law. A responsible assessment may conclude that the intended application should not be made, that further evidence is essential or that another route is safer. That advice is part of protecting the client, not a failure to advocate.

05 / Processing

Priority processing and favourable merits are different things.

Where the Home Office offers a priority or super priority service for the particular application, that is an official processing option subject to eligibility, availability and the published conditions. It is not an enhanced merits test. A complex case may need additional checks or evidence and may take longer than the usual service period.

Compare the processing option only after the case is legally ready. Buying speed does not correct a missing qualifying period, a current-route defect or an unsupported absence explanation. It also does not guarantee that the decision will be made before a future rule change. No client should pay for a supposed special channel based on a lawyer's influence.

If a refusal or serious delay has already occurred, review the full decision and procedural position. Appeal, administrative review, a fresh application and judicial review are not interchangeable. Protect the actual deadline and identify the relief sought before presenting a challenge as the inevitable next step.

06 / Wider consequences

An individual Long Residence grant does not settle the household.

Long Residence has no dependant settlement application through which a partner or child simply follows the successful applicant. Review each family member's own route and future permission, including the effect of one adult settling before the others. Do not withdraw or vary another person's application merely because the principal case appears stronger.

For someone not yet close to qualifying, compare a genuine work, talent or family route with the lawful continuation of current permission. Switching may be sensible, but the present and future counting rules must be considered separately. A person cannot retrospectively turn study years into time held as a main applicant on a work route.

The instruction should finish with a practical schedule: what can be filed now, what evidence remains, which permission expires first and which publication triggers a fresh legal review. That is a meaningful service for a client facing change. A promise that the lawyer will somehow secure a better decision than the Rules allow is not.

10 year route assessment

Identify the legal route before choosing the application date.

Bring the complete immigration file, not only the latest permission.

01

Name the route

Separate Long Residence, family/private life and the announced earned model.

02

Rebuild the chronology

Classify every grant, pending period, gap and absence.

03

Check the current gates

Test the current-route period, suitability, language and knowledge requirements.

04

Resolve the timing

Check the lawful window, expiry, travel and any published saving.

05

Protect the fallback

Plan further permission, family applications and any decision-specific remedy.

Practical questions.

Is the 10 year Long Residence route already closed?

No, as at 6 November 2026 it remains in the consolidated Rules. The Government has announced its closure under earned settlement. Check the implementing text before relying on a future application or a presumed transition.

Can your lawyers obtain a preferential ILR decision?

No. Quastels can prepare evidence-led representations, identify applicable exceptions and advise on lawful remedies. The Home Office decides the application under the applicable law; representation does not buy preferential treatment or a guaranteed grant.

Does super priority improve the chance of approval?

It is a processing service, not a different eligibility standard. Availability and timing conditions apply, and complex cases may take longer. The evidence and legal requirements must be met regardless.

Is the 10 year family route the same as long residence?

No. The permission and settlement requirements are different. A person may need both assessments, but should not transfer a counting rule or concession from one route to the other without authority.

The useful distinction is between a case that meets today's Long Residence Rules, a family or private-life pathway and a future earned-settlement assessment. Establish that distinction early. Then instruct lawyers for the chronology, evidence, timing and lawful advocacy the case needs, not for preferential treatment which they cannot provide.

Classify the decision, preserve the remedy and protect the objective.

A refusal, status problem or enforcement step should be analysed before a challenge or repeat application is chosen. Procedure, evidence and timing must be controlled together.
