Can you travel while an ILR application is pending?

Leaving the Common Travel Area before an in-country ILR decision normally withdraws the application automatically. Ireland is not a simple workaround: paragraph 34K and section 3C use different geographical tests, while a main applicant’s departure can leave dependant applications exposed under new Home Office guidance.

A retained passport is not permission to travel without affecting ILR.

This analysis applies paragraph 34K, section 3C and version 12.0 of the Home Office validation and withdrawal guidance, published on 14 October 2026. That guidance adds a specific procedure for dependants who remain in the UK after the main applicant leaves the Common Travel Area.

The position

Travel outside the Common Travel Area normally withdraws a pending ILR application

No, not without a serious consequence. An in-country application for indefinite leave to remain is an application for permission to stay. Under paragraph 34K, if the applicant travels outside the Common Travel Area before the Home Office decides it, the application is treated as withdrawn on the date of departure. The Common Travel Area comprises the UK, Ireland, the Channel Islands and the Isle of Man. Travel only within that area does not engage paragraph 34K, but leaving the UK can still end section 3C leave. The route, existing permission, family applications and return position must therefore be checked before any journey.

  • The consequence follows from departure; asking for the passport back, keeping an eVisa or having a compelling reason to travel does not create an exception to paragraph 34K.
  • A main applicant’s withdrawal does not automatically withdraw dependant applications which remain in the UK, but those applications may cease to meet their route requirements.
  • Citizenship and EU Settlement Scheme applications have different frameworks; the paragraph 34K answer should not be transferred to them without checking the applicable rules.

A settlement applicant may retain their passport and continue to see valid limited permission in a UKVI account while the application is pending. That can look like practical freedom to travel. It is not. The decisive question is what departure does to the outstanding application and, if the previous permission has expired, to the statutory leave which preserves the applicant’s position while waiting.

The ordinary answer for an in-country ILR application is strict. Travel beyond the Common Travel Area causes automatic withdrawal under paragraph 34K. The Home Office does not need to agree to a withdrawal request first, and later discovery through exit records does not preserve the application. A journey can therefore remove the settlement application, end section 3C leave, consume a substantial fee and disrupt connected dependant cases.

The useful analysis separates 4 questions: whether paragraph 34K withdraws the application; whether section 3C leave exists and ends; whether the person can lawfully return; and what happens to each dependant’s application. The answers use different legal tests and should not be compressed into the advice simply to avoid travel.

01 / Paragraph 34K

Withdrawal occurs on departure, not when the Home Office notices it.

Paragraph 34K provides that where a decision on an application for permission to stay has not been made and the applicant travels outside the Common Travel Area, the application is treated as withdrawn on the date the applicant left. An ILR application made in the UK is an application for permission to stay for this purpose. The rule applies whether the journey is for work, a holiday, a family emergency or another compelling reason.

The current caseworker guidance directs the Home Office to apply the withdrawal even if the applicant did not report the journey and the departure is discovered later through an exit check. It is therefore unsafe to assume that a short trip, rapid return or absence of immediate correspondence means the application remains live.

The legal event is departure from the Common Travel Area. Completing biometrics, uploading every document, receiving a confirmation email or retaining a valid passport does not protect the application from that event. Nor should an applicant rely on a decision being imminent unless the grant has actually been made before departure.

02 / Geography

Ireland is inside the paragraph 34K area, but outside the United Kingdom for section 3C.

For paragraph 34K, the Common Travel Area comprises the United Kingdom, the Republic of Ireland, the Channel Islands and the Isle of Man. A journey from England to Ireland does not, by itself, cross the paragraph 34K boundary. A journey from Ireland to France does. Routing an overseas trip through Dublin therefore does not avoid withdrawal once the applicant leaves the Common Travel Area.

Section 3C uses a different boundary. It extends qualifying existing leave while an in-time application and any protected challenge remain pending, but the statute provides that the extended leave lapses if the person leaves the United Kingdom. Home Office guidance confirms that section 3C leave ends when the person leaves the UK. Travel to Ireland can therefore avoid paragraph 34K withdrawal yet still end section 3C leave if that is the leave on which the applicant depends.

This distinction makes an Ireland trip a legal-status question, not a travel shortcut. The applicant’s original permission may still be current, may have expired so that section 3C is operating, or may contain route-specific conditions relevant to return and work. Entry through the Common Travel Area also requires a separate analysis. Do not book the journey until those facts have been mapped.

03 / Continuing status

A pending ILR application does not itself grant settlement conditions.

Section 3C can extend existing limited leave where a valid application was made before that leave expired and the statutory conditions are met. While it operates, the previous conditions ordinarily continue. A Skilled Worker generally remains subject to their sponsored-work conditions; a partner applicant remains on the conditions of the previous partner grant. The application does not create unrestricted settled status while it is undecided.

If the person leaves the UK while relying on section 3C, that leave ends. If they also travel outside the Common Travel Area, paragraph 34K withdraws the application. The applicant may then have neither the outstanding ILR application nor the section 3C leave on which work, rent and residence were being maintained.

Where the person’s original permission has not yet expired, section 3C may not have begun. That does not make overseas travel harmless: paragraph 34K still withdraws the ILR application outside the Common Travel Area, and the person must establish what permission, if any, supports return and a later application. The current eVisa record should be evidence in the analysis, not a substitute for it.

04 / Family applications

The main applicant’s departure can leave dependant cases alive but defective.

Version 12.0 of the Home Office validation and withdrawal guidance, published on 14 October 2026, introduces a specific paragraph 34K procedure for dependants. Where the main applicant and dependants applied together, the main applicant leaves the Common Travel Area and the dependants remain in the UK, the main application is withdrawn but the dependant applications remain outstanding.

Outstanding does not mean safe. The guidance recognises that the dependants may no longer meet the route-specific requirement connected to the main applicant. The Home Office must write to them, explain the effect and invite them to submit a valid further application within 14 days and before their cases are decided. If valid, that further application may vary the outstanding one under paragraph 34BB, unless an exception applies.

If no action is taken, the dependant application may be rejected as invalid or refused under the applicable route. Each family member’s current permission, section 3C position, eligibility for another route and evidence must be considered separately. A family should not assume that the main applicant’s urgent departure merely pauses one part of a joint settlement plan.

05 / Cost

Automatic withdrawal can also mean losing the application fee.

The October guidance states that where biometrics have already been submitted, or documents have been submitted online in a case where no biometrics are required, the application fee is not refunded after paragraph 34K withdrawal. The wider refunds policy allows refunds for withdrawals only in specified stages and circumstances. A substantial settlement fee should therefore be treated as at risk once the application has progressed.

A refund question does not preserve immigration status. Even where a particular payment may be recoverable, withdrawal and section 3C consequences must be assessed independently. The Immigration Health Surcharge will not normally arise on a settlement application in the same way as on limited permission, but priority or ancillary payments have their own refund rules.

Do not treat voluntary withdrawal immediately before departure as a device which necessarily improves the position. It can bring section 3C leave to an end, affect refund eligibility and leave no valid basis for work or return. The sequence should be chosen only after the present status and viable next application are established.

06 / Urgent need

Compassionate travel does not create a paragraph 34K waiver.

Bereavement, serious illness and urgent business obligations can make waiting extremely difficult. Paragraph 34K does not contain a general exception for those circumstances. Contacting UKVI, an MP or an adviser may help establish the procedural options, but an informal indication that a case is urgent should not be treated as permission to leave without withdrawal.

Before applying, compare the expected decision service with any known travel. GOV.UK lists priority and super priority options for specified in-country settlement routes, subject to route, identity method, capacity and eligibility. The faster service is not available for every case, and a standard application cannot safely be assumed to be upgradeable after submission.

After submission, establish whether a decision has actually been made, whether any paid service was used, whether published processing time has passed and whether there is a recognised escalation channel. If departure cannot wait, obtain advice on the consequence of withdrawal, current leave, return, a fresh application and every dependant before travelling. Urgency changes the decision the family must make; it does not change paragraph 34K.

07 / Do not generalise

Citizenship and EU Settlement Scheme cases require their own travel analysis.

Paragraph 34K concerns an application for permission to stay. A British citizenship application is not such an application, so it is not automatically withdrawn under paragraph 34K merely because the applicant travels. Citizenship has its own residence, future-intention and ceremony questions, and existing immigration status must remain secure until naturalisation is completed.

Appendix EU contains a distinct application and withdrawal framework. A person with a pending EU Settlement Scheme case should use the rules, certificate and border guidance which apply to that scheme rather than assuming the ILR answer controls. Protection, administrative review, appeal and travel-document cases can also engage separate provisions.

The application label and legal basis matter. Advice that says all pending Home Office applications prohibit travel is too broad; advice that a retained passport always permits travel is too loose. Identify the actual application, the travel boundary in its rules, the person’s current leave and the document needed to return.

08 / Decision sequence

Resolve the journey before paying for settlement.

A sound filing plan records the earliest eligible application date, current permission expiry, expected processing service, biometric route, known travel, work or study conditions and every connected family application. Where foreseeable travel conflicts with the decision window, consider travelling first and applying on return if the person remains eligible and can do so lawfully.

If the application is already pending, confirm whether the proposed destination lies outside the Common Travel Area, whether section 3C is operating, whether the original permission remains valid, and how the person would seek re-entry. Then map the consequences for fees, employment, residence continuity, dependants and the evidence for any later application.

A travel booking is not merely a logistical choice once settlement is pending. The lowest-risk answer may be to wait for the decision; the commercially necessary answer may be to withdraw and rebuild the immigration sequence. Either conclusion should follow from the actual status record, not from the fact that the applicant still holds a passport.

Pending-settlement travel framework

Answer 7 questions before leaving the UK.

The sequence separates automatic application withdrawal from section 3C, return and family consequences.

01

Identify the application

Confirm that the pending case is ILR or another application for permission to stay and record its submission date.

02

Map the destination

Establish whether the complete journey remains inside the Common Travel Area or crosses its boundary.

03

Fix the current leave

Check the original permission expiry and whether section 3C is extending its conditions.

04

Test return

Identify what permission and travel evidence would support carriage and re-entry after departure.

05

Separate every dependant

Record who applied, who will travel, who remains and whether the October 2026 variation procedure may apply.

06

Calculate financial loss

Check biometrics, document submission and the refund policy without confusing money with status.

07

Choose the lawful sequence

Wait, seek an available faster decision, travel before filing, or withdraw and reapply only after assessing all consequences.

Practical questions.

Can I leave the UK while my ILR application is being processed?

If you travel outside the Common Travel Area before the decision, paragraph 34K treats the ILR application as withdrawn on the date you leave. The Common Travel Area is the UK, Ireland, the Channel Islands and the Isle of Man. Section 3C and return consequences must also be checked.

Can I travel to Ireland while waiting for ILR?

Travel to Ireland does not by itself cross the paragraph 34K boundary, but section 3C leave ends on leaving the United Kingdom. If your previous permission has expired and you rely on section 3C, an Ireland trip can therefore have a serious status consequence even though the application is not withdrawn under paragraph 34K.

Will the Home Office refund my ILR fee if travel withdraws the application?

Often not once the application has progressed. Current withdrawal guidance says the fee is not refunded where biometrics have been submitted, or where documents were submitted online in a case needing no biometrics. The detailed refund policy and stage of the application should be checked.

What happens to my dependants if I travel and they stay in the UK?

The main application is withdrawn under paragraph 34K, while dependant applications may remain outstanding. Under guidance published on 14 October 2026, the Home Office should invite remaining dependants to make a valid further application within 14 days before deciding their cases, because the original route requirements may no longer be met.

Does an emergency allow travel without withdrawing the ILR application?

Paragraph 34K contains no general exception for urgent or compassionate travel. Before departure, assess whether a decision can be obtained, whether waiting is possible, and the consequences of withdrawal, loss of section 3C leave, return and any fresh application.

Can I travel while a British citizenship application is pending?

A citizenship application is not an application for permission to stay and is not automatically withdrawn by paragraph 34K. The applicant must still preserve immigration status until naturalisation is complete and consider residence, intention, ceremony and travel-document issues separately.

A pending ILR application is not a travel ban, but departure can destroy the application and the status relied upon while it is considered. Paragraph 34K, section 3C, return and dependant applications must be analysed separately. The safest sequence is designed before filing; once an urgent journey arises, the decision must be made before the applicant crosses the relevant boundary.

Plan the family's status as one connected position.

Partner, child, residence, travel and settlement questions can produce different answers for different family members. The next application should preserve the intended longer-term position.
