Professional collaboration · Investors, accelerators, venture advisers and founder communities

Immigration counsel for investors, accelerators and founder advisers.

A venture may be commercially attractive while the founder's immigration permission, endorsing body position or ability to remain in the UK is less secure than the cap table suggests.

Investment readiness and immigration eligibility are connected, but they are not interchangeable.

The proposed route, business endorsement, founder's operational role, investor protections, commercial evidence and family circumstances should be considered together. Immigration advice can support the venture and its advisers without taking over fundraising, investment negotiations or the founder's wider commercial relationships.

The immigration issue should be identified before it changes the wider instruction.

01

Investment rounds and founder control.

Assess whether board appointments, reserved matters, investor vetoes or revised executive roles leave the endorsed founder genuinely involved in developing the venture.

02

Endorsement and business model changes.

Test whether a pivot, revised product, new market or changed team materially alters the business proposition on which the founder's endorsement depends.

03

Route selection and workforce planning.

Compare Innovator Founder, Global Talent, sponsored employment and lawful company sponsorship against the founder, business and intended recruitment model.

04

Settlement, cofounders and family planning.

Map future endorsement, qualifying business outcomes, each founder's contribution, dependants and the timing of any settlement decision.

Clear scope, controlled information and an intact professional relationship.

01

Identify the venture position.

Confirm the founder, current immigration route, endorsing body, funding event and the decision the professional adviser is trying to progress.

02

Review the control structure.

Consider the proposed investment documents, ownership, founder responsibilities and material changes against the actual immigration requirements.

03

Define the legal workstream.

Agree whether the instruction concerns endorsement, a route change, sponsor licensing, a transaction or longer term family planning.

04

Coordinate with the venture team.

Provide appropriately scoped advice alongside corporate counsel, investors and founder advisers, subject to conflicts, confidentiality and client authority.

Points to establish before an introduction.

01Does raising investment automatically make a founder eligible for an Innovator Founder visa?+

No. The individual needs a valid endorsement and must meet the route's requirements, including the necessary connection to an innovative, viable and scalable business and genuine operational involvement.

02Can a founder remain eligible after dilution or a change of chief executive?+

Potentially. The analysis turns on the founder's real role in managing and developing the endorsed business, the structure of the venture and the endorsing body's position.

03Can an accelerator guarantee an Innovator Founder endorsement?+

No. Only a body authorised to endorse the relevant route can issue an endorsement, and the applicant must satisfy the applicable Immigration Rules and endorsement criteria.

04Can multiple founders rely on the same business achievements for settlement?+

The relevant settlement and endorsement requirements apply to each founder individually. Shared business outcomes must be assessed carefully against the operative rules and each person's actual contribution.
