Practical counsel frameworks

Carry the right questions
into the decision.

Four concise frameworks for immigration positions that should not begin with a form. Use them to organise the issue, expose the evidence gap and decide what requires a fact-specific legal view.

Begin with the proposition that must withstand scrutiny.

These are working frameworks, not eligibility tools. Read the relevant note once, answer its questions without advocacy, and then identify what cannot yet be proved.

The value lies in the gap between an intended position and the evidence presently available. That is often where the real immigration decision begins.

01

For boards and sponsor key personnel

Sponsor Licence Board Checklist

A licence is only as resilient as the operating evidence behind it.

Use this framework before a board review, compliance visit, transaction or internal audit. It is designed to expose the point at which a written policy ceases to describe what the business actually does.

  1. 01

Who owns each sponsor duty in practice?

  2. 02

Do the CoS, contract, payroll and actual role agree?

  3. 03

Are absences, changes and reporting decisions evidenced?

  4. 04

Can the organisation retrieve a complete worker record promptly?

  5. 05

What is escalated, to whom, and within what time?

02

For founders and international businesses

UK Market Entry Decision Note

The immigration route should follow the commercial proposition—not disguise its weaknesses.

Use this note before incorporating, fixing ownership, appointing directors or committing to a route. It separates the founder’s personal objective from the evidence the UK business and proposed role must withstand.

  1. 01

What must the UK structure achieve commercially?

  2. 02

Is endorsement, sponsorship or another route the better fit?

  3. 03

Does the proposed role arise from a credible operating need?

  4. 04

Can ownership, control and sponsor governance coexist properly?

  5. 05

What sequence avoids avoidable cost or rework?

03

For leaders in technology, arts and research

Global Talent Evidence Architecture

Evidence is persuasive when every document proves a defined proposition.

Use this framework before requesting recommendation letters or assembling a portfolio. It tests the field, threshold, attribution and independent recognition before presentation begins.

  1. 01

Which field and endorsement standard actually apply?

  2. 02

What is the principal claim to recognition or promise?

  3. 03

Which achievements can be attributed to the applicant?

  4. 04

Where is the independent evidence of significance or impact?

  5. 05

What must each letter add that the documents cannot?

04

For refusals, adverse action and urgent positions

Refusal and Review Response Matrix

The first decision is not how to answer. It is which remedy can still serve the objective.

Use this matrix on receipt of a refusal, suspension, cancellation or other adverse action. Preserve the decision, deadline and evidence before assuming that review, challenge or a fresh application is the correct response.

  1. 01

What decision was made, under which power and when?

  2. 02

What remedy exists and what deadline controls it?

  3. 03

Is the problem factual, evidential, procedural or legal?

  4. 04

Can further evidence be considered in the available process?

  5. 05

Which response best protects the underlying objective?

When the framework exposes a material question.

Quastels can review the objective, present legal position, operative evidence and timing, and identify the decision that should be made next.
