Current routes versus announced framework · Checked 6 November 2026
No general earnings-based 3 year ILR application is open today.
Existing route-specific settlement provisions remain available to qualifying applicants. The earnings pathways in the 2 November response require implementation. Future thresholds should not be imported into an existing Global Talent or Innovator Founder case.
The position
Can you secure ILR after 3 years?
Potentially, under an existing qualifying Global Talent or Innovator Founder route, provided every settlement requirement is met. Earning a high salary alone does not currently shorten Skilled Worker settlement to 3 years. The November earned-settlement response announces a future 3 year earnings pathway using £125,141 in 3 of the previous 4 years, but the implementing Rules, eligible permission and other conditions must be checked before anyone can rely on it.
- A shorter qualifying period is not faster processing or guaranteed approval.
- Switching routes can preserve some residence in one category and restart the relevant clock in another.
- Partners and children require their own current settlement assessment.
An executive, researcher or founder asking for accelerated settlement is usually asking a commercial question: what is the earliest sustainable route to permanent status without creating a larger risk for the business or family? The answer requires a comparison of eligibility, evidence, residence and timing. It cannot be obtained by choosing the visa with the shortest headline.
The November response makes that comparison more important. There are now existing 3 year settlement provisions and an announced future contribution model in the same discussion. They should be placed side by side, not blended into a route which the Rules do not contain.
01 / Available now
Global Talent: the endorsement category determines the period.
Under GT 11.1, the 3 year period covers the specified academic and research endorsers, exceptional talent endorsements through Arts Council England or Tech Nation, and initial grants based on an eligible listed prize. Exceptional promise through Arts Council England or Tech Nation ordinarily carries a 5 year settlement period. The distinction is not resolved by how senior the applicant now feels their role has become.
Settlement also requires relevant UK earnings during the last period of Global Talent permission and continuing compliance with the applicable endorsement or prize provisions. The Rule does not impose the announced future £125,141 threshold on a current Global Talent settlement case. A substantial salary is not a substitute for showing the connection between the work and the endorsed field.
Certain earlier main-applicant permissions can contribute under GT 11.3. That can make a genuine switch commercially valuable, but the applicant must first qualify for Global Talent permission and satisfy the settlement requirements. An endorsement application alone is not that permission. UKIC's separate analysis of Skilled Worker to Global Talent examines the detailed counting and family issues; this comparison does not duplicate it.
02 / Available now
Innovator Founder: 3 years is a business performance test, not a purchase.
Innovator Founder settlement requires the relevant 3 years in that route, a fresh qualifying endorsement and the business conditions in INNF 17. The venture must demonstrate the required achievement and sustainability, with an active founder role and at least 2 specified business success criteria. Receiving initial endorsement does not establish that those later conditions will be met.
The residence difference is decisive. Earlier Student, Graduate or Skilled Worker time is not simply added to the Innovator Founder settlement period. Someone who already has a credible nearer settlement date elsewhere may delay it by switching. Conversely, a genuine qualifying founder who is early in their UK journey may have a sound reason to select this route from the beginning.
Investment, revenue, customers, research and jobs require their own evidence and cannot be engineered retrospectively by changing labels. Before choosing 2 criteria, assess what the venture can actually deliver, when the evidence will exist and whether the endorser can properly support settlement. The detailed UKIC founder analyses address those individual criteria. A promise to secure ILR for putting money into a company is not an accurate description of this route.
03 / Announced future model
A new salary today does not establish a historic earnings pathway.
Chapter 2 of the Government response announces a 3 year pathway based on earnings of at least £125,141 in 3 of the 4 years before application, and a 5 year pathway using at least £50,271 in 3 of the previous 5 years. Those are features of the future framework, not a freestanding current application category. The permitted immigration route and mandatory conditions remain separate gates.
For an employer or owner-managed business, the useful preliminary task is to reconcile actual personal earnings with tax and payroll records. Do not assume that a new employment contract, business valuation, retained profits or a one-off transfer proves the required years. Do not assume dividends, overseas income or an artificial salary arrangement will be accepted without the final definitions and evidence provisions.
The response's highest-talent treatment also carries a review qualification pending Migration Advisory Committee work. It should not be marketed as an immutable guarantee that every future Global Talent or Innovator Founder holder will keep precisely today's settlement structure. Existing provisions can be used now where satisfied; future protection must be assessed from the actual implementing text.
04 / Other opportunities
A sound 5 year pathway can be better than a speculative 3 year switch.
The announced model recognises specified health and education occupations and recognised British connections as grounds for a 5 year pathway, subject to conditions. Existing residents should test those possibilities rather than assume earnings are the only relevant contribution. A job title or marriage alone is not enough: the permission, occupation and full applicable test must match.
Some people already hold a closed or legacy route with its own settlement provisions. The response identifies separate arrangements, including Tier 1 Investor. That does not reopen a closed category to a new applicant. Existing holders need advice under their actual grant and provisions, not a generic recommendation that anyone can obtain accelerated settlement by investing.
Other current provisions, including qualifying bereaved partner or domestic abuse cases, can permit settlement without the ordinary residence wait. They are protective routes for particular circumstances, not alternatives to select to accelerate an otherwise unrelated work case. The starting point must be the person's real facts and safety needs.
05 / The comparison
Calculate the earliest complete case, including the family.
Create a dated comparison for the current route, each genuinely available alternative and the announced future scenario. For each, identify which residence counts, the earliest defensible application point, the evidence lead time, endorsement or sponsor dependency and the cost of maintaining permission. Include the risk of refusal and the fallback if an endorsement or business target is not achieved.
Apply Appendix Continuous Residence to the relevant route and period. High earnings do not excuse excess travel. A research-related absence exception may assist a qualifying Global Talent case, but it is not a general exemption for every frequent traveller or accompanying relative. Keep the precise rule and evidence beside the travel calculation.
Under current work-route dependant rules, a principal applicant's 3 year settlement does not generally give a partner a matching 3 year entitlement. The November response points towards a different family approach, but it has not displaced today's provisions. Model current family applications and the proposed future position separately, especially where a partner arrived later or a child is approaching an age threshold.
06 / Execution
Secure the evidence and permission, not an advertised result.
The practical legal work begins before filing: verify route fit, obtain the proper endorsement where required, reconcile residence and income evidence, identify suitability issues and prepare the application under the operative Rules. For a founder, the business and settlement plan should be reviewed early enough to change lawful operations prospectively. For a professional, the case should show actual achievement rather than rewritten job marketing.
Keep 26 March 2027 under review for the published B2 English change in applicable settlement routes. Check the specific appendix, exemption and application date. Meeting B1 now, receiving an endorsement or booking a test does not necessarily establish the language requirement for a later application. Do not select an unsafe filing date solely to avoid a test.
Priority processing is a different service from a shorter qualifying period. Neither paying for speed nor instructing lawyers purchases preferential treatment. Quastels can assess the earliest legally sustainable strategy, prepare the supporting case and advise on remedies where warranted. It cannot guarantee that a route will remain unchanged or that the Home Office will grant the application.

Practical questions.
Does earning £125,141 currently give me ILR after 3 years?
Not by itself. That is an announced feature of the future earned-settlement framework. Current applications must meet an existing settlement route; the future model still requires implementing Rules and other conditions.
Is every Global Talent applicant on a 3 year settlement route?
No. The qualifying period depends on the endorsing pathway or eligible prize. Exceptional promise through Arts Council England or Tech Nation ordinarily requires 5 years under the current Rules.
Can I add Skilled Worker time to Innovator Founder settlement?
Not to the route's required 3 years as an Innovator Founder. Global Talent has different combination provisions, which must not be transferred to the founder route.
Can Quastels guarantee accelerated ILR?
No. Quastels can assess route fit, the earliest sustainable timetable, supporting evidence and family consequences. A grant depends on satisfying the applicable requirements and the Home Office decision.

Accelerated settlement is achieved by satisfying an available route in full, not by selecting a headline period. Compare current Global Talent and Innovator Founder eligibility with the existing route, then treat the new earnings pathways as a separate forward-looking scenario until the Rules make them operational. The result should be the earliest defensible plan for the individual and household, with an honest fallback.
