Flagship counsel analysis · Checked 22 September 2026
Growth and comparative scale must both be established.
This article analyses existing requirements, not a newly announced change. INNF 17.1(f)(ii) contains the legal test. The Home Office guidance explains an evidential alternative where competitor customer numbers are unavailable. The record design and commercial examples below are practical analysis, not additional statutory conditions or reported client outcomes.
The position
Does doubling customers qualify an Innovator Founder for ILR?
Not by itself. INNF 17.1(f)(ii) requires the business’s customer number to have at least doubled within the most recent 3 years and currently to exceed the mean for other UK businesses offering comparable main products or services. Home Office guidance accepts credible evidence of an above mean market share where comparable competitor customer numbers are unavailable. This is 1 achievement, not 2; another qualifying achievement and all remaining settlement requirements must also be met.
- Revenue growth, downloads and registered users do not automatically prove customer growth.
- The market comparison cannot be omitted merely because competitor data is difficult to obtain.
- A methodology discussed with an endorsing body is not a guarantee of endorsement or settlement.
A founder approaching settlement may have a convincing commercial story: customer acquisition has accelerated, recurring revenue is growing and the board regards the venture as a success. The settlement spreadsheet marks customer growth as achieved. Only later does someone ask which comparable UK businesses were measured, what their customer numbers were and how the mean was calculated.
That is not a request for decorative market research. It is the second limb of the chosen criterion. A business can grow quickly from a small base while remaining below the relevant comparative mean. Another can be commercially valuable with very few customers because each contract is substantial. Neither commercial proposition should be confused with satisfying this particular immigration test.
The strategic question is therefore not simply whether the founder can produce a better chart. It is whether this criterion can be proved reliably, on time and without changing the meaning of a customer between the growth calculation and the market comparison. That question belongs in settlement planning while the business still has choices.
01 · The legal test
A percentage increase and a market position are separate propositions.
Appendix Innovator Founder INNF 17.1(f)(ii) requires at least a doubling within the most recent 3 years and a current customer count higher than the mean for other UK businesses offering comparable main products or services. Both limbs apply. The rule does not substitute revenue, valuation, funding secured or a percentage growth rate for that comparison.
The words higher than matter. Matching the relevant mean is not the same as exceeding it. Nor is the median interchangeable with the mean. A report which says that the venture has more customers than most competitors may still leave the required calculation unresolved.
A simplified arithmetic illustration makes the distinction. Assume a valid comparison universe of 3 other businesses with 40, 60 and 200 customers. Their mean is 100, although the middle value is 60. A venture which grows from 45 to 90 has doubled and exceeds the middle value, but remains below the mean. These are invented teaching figures, not market data or an endorsed benchmarking method. A real comparison must first justify its universe and evidence.
02 · The unit of account
Decide what is being counted before relying on the growth rate.
Neither the cited rule nor the customer base section of the endorsing body guidance supplies a universal counting formula for every business model. That does not make every internal metric a customer. The file must explain the commercial relationship represented by the count and why the same unit can be used consistently across time and comparators.
For enterprise software, 1 paying company, 12 divisions and 800 user seats may describe the same contract. Counting company accounts at the baseline and user seats at settlement would manufacture growth through a change in definition. A marketplace needs to explain whether its customers are buyers, sellers or another contracting party. A subscription business should distinguish a current relationship from a cancelled subscription retained in its database.
Free accounts, trials, dormant registrations, repeat orders and related party accounts require explicit treatment. This is not a claim that the Rules universally exclude every free user or demand one prescribed accounting definition. It is a warning that downloads, transactions and customers answer different questions. Where classification is material, put the methodology and its limitations to the endorsing body rather than silently choosing the largest number.
03 · The internal record
Reconstruct the customer population, not just the dashboard total.
The growth limb should have identifiable comparison dates within the most recent 3 years, a consistent definition and an auditable connection to the underlying business records. The wording does not say that every business must have traded throughout all 3 years. Nor does it identify the visa grant date as a universal counting baseline. The selected period still needs to demonstrate genuine doubling within the prescribed window.
A useful working schedule starts with the baseline customer population, identifies additions and departures, reconciles duplicate or merged records and produces the current population. Retain dated CRM exports, relevant contracts, invoices or subscription records and an explanation of any system migration. A report created now can explain historic records; it cannot establish an unrecorded baseline merely by assertion.
A zero or negligible starting count deserves particular care. Multiplying zero by 2 does not demonstrate meaningful customer growth. Do not assume that an arithmetical presentation beginning before launch resolves the endorsement assessment. Show the actual trading chronology and obtain a reasoned view on whether the evidence proves the criterion. Avoid selecting an artificial trough while withholding the rest of the customer history.
04 · The comparator
Comparable means more than sharing a sector label.
The legal anchor is other UK businesses offering comparable main products or services. A broad industry code can identify a starting population, but it does not necessarily distinguish an enterprise licence from a consumer subscription, a specialist diagnostic product from general healthcare software, or a platform from a consultancy using it.
The comparison report should explain the main product or service, the relevant commercial model, which UK businesses were included and why others were excluded. Product scope, customer type and the measurement unit can materially affect comparability. Do not narrow the market to a convenient local niche or remove larger competitors simply because their inclusion makes the threshold harder to meet.
Equally, the test should not be distorted by comparing unlike businesses merely because data is easy to obtain. A worldwide user number for an international group may not measure the same thing as a UK business’s customer base. The report needs to identify whose customers are counted and what the source covers. The Rules refer to comparable UK businesses; that should not be rewritten as an unsupported universal requirement that every customer counted must live in the UK.
05 · Evidence quality
A benchmark must survive disclosure of its assumptions.
The Home Office endorsing body guidance calls for credible evidence and gives comparison with industry data sources as an example. It does not prescribe a universal approved database or a fixed minimum sample size. Commissioning a market report does not remove the need to assess what the report actually establishes.
For each source, record the publication date, period measured, customer definition, business coverage and whether the number is reported, estimated or inferred. An independently published number can still be unsuitable if it counts something different. Conversely, a carefully evidenced estimate should be described as an estimate, with its method and uncertainty visible, rather than presented as an observed fact.
If only a sample is available, explain how it supports an inference about the relevant mean. A convenient list of 3 low volume competitors is not automatically evidence of the wider comparison. Show how exclusions and plausible alternative classifications affect the result. If reasonable changes reverse the conclusion, the founder should know that before relying on the criterion as secure.
07 · Commercial judgment
The best commercial metric may be the wrong settlement criterion.
An enterprise business can improve margins by concentrating on fewer, larger clients. A subscription venture may deliberately remove low value accounts. Those decisions can be commercially sound while weakening a customer number case. Immigration advice should identify that tension, not encourage artificial acquisition of nominal customers to improve a chart.
A rational assessment separates 3 situations. The achievement exists and the evidence needs organising. The achievement may exist but the market comparison remains unproved. Or the available evidence shows that the criterion is not met. Each calls for a different decision. More polished drafting cannot turn the third into the first.
Where customer growth is an insecure choice, test another genuinely available achievement rather than forcing the evidence. Investment actively spent, qualifying R&D, revenue and job creation have distinct requirements and cannot be assumed from commercial success alone. Some need a completed accounting period or a sustained employment history. A late change of criterion may therefore require more time, not simply different documents.
08 · The complete settlement case
2 limbs make 1 achievement, and endorsement is not the whole application.
Doubling and outperforming the comparative mean together satisfy only the customer criterion. INNF 17.2 prohibits relying on the same criterion twice. INNF 17.3 separately restricts founding team members from sharing the same means of satisfying the achievements. A company wide growth report should not simply be copied into multiple founders’ applications without addressing that rule.
INNF 17.1 also requires significant achievements against the earlier business plan, company registration, the founder’s position as director or member, active trading, a key day to day role and apparent sustainability for at least the next 12 months. A customer increase driven by unsustainable discounts does not dispense with the sustainability assessment.
The applicant needs a qualifying settlement endorsement issued no more than 3 months before applying, together with the applicable qualifying period, continuous residence, knowledge of life and suitability requirements. If the evidence will not support settlement before current permission expires, consider extension eligibility and timing promptly. An unfinished endorsement assessment does not itself extend immigration permission. Do not treat a possible alternative outcome of a settlement application as a substitute for planning.

Practical questions.
Is doubling customer numbers enough for Innovator Founder settlement?
No. The current count must also exceed the mean for comparable UK businesses. The 2 limbs together represent 1 settlement achievement; another qualifying achievement and the remaining requirements are needed.
Can I use revenue growth instead of customer growth?
Revenue growth alone does not prove this criterion. Revenue has separate settlement criteria. Where competitor customer counts are unavailable, the guidance accepts credible above mean market share analysis, but a revenue based model requires a reasoned explanation rather than an assumption that the measures are equivalent.
Do free users or app downloads count as customers?
Not automatically. The published customer criterion does not supply a universal formula for every business model. Explain the actual commercial relationship and use a consistent, credible definition for the company and its comparators. Discuss material classification issues with the endorsing body.
What if competitors do not publish customer numbers?
The endorsing body guidance accepts credible market share analysis showing an above mean average share where comparable competitor customer numbers are unavailable. That does not remove the need to prove the business’s own customer doubling.
Is there a Home Office approved market research database?
The cited customer base guidance gives industry data sources as an example but does not prescribe a universal approved database. The relevance, consistency, coverage and credibility of the evidence must be assessed.
Can customer doubling and above average market share count as my 2 achievements?
No. They address parts of the same customer criterion. INNF 17.2 prevents counting that criterion twice.

The customer criterion is not a reward for a persuasive growth story. It requires a defensible account of what the business counts, how that population grew and where it now stands against a credible comparison. Resolve those questions before the criterion becomes a fixed assumption in the founder’s settlement plan.
