Professional collaboration · Universities, education providers and student mobility advisers

Immigration counsel for universities and education advisers.

International recruitment, admission decisions and institutional sponsor compliance interact with individual student status, graduate opportunities and the legal duties owed by the education provider.

An admissions decision is not a substitute for a sponsor compliance decision.

Student sponsor obligations, Confirmation of Acceptance for Studies controls, basic compliance assessment metrics, individual case histories and post study immigration routes must each be considered on their own terms. Advice can be coordinated with institutional counsel, compliance teams and international education advisers without misrepresenting admission as an immigration guarantee.

The immigration issue should be identified before it changes the wider instruction.

01

Student sponsor governance and institutional risk.

Review sponsor oversight, key personnel, reporting and documented controls against the current Student sponsor guidance and the provider's actual operating model.

02

CAS decisions and individual application issues.

Consider the admission record, proposed course, timing, prior immigration history and whether issuing or relying on a CAS requires further legal scrutiny.

03

Basic Compliance Assessment preparation.

Examine refusal, enrolment and course completion information in context, and identify evidence or escalation issues before an institutional assessment becomes urgent.

04

Graduate and founder progression.

Assess the student's current permission, timing, dependants and potential progression to Graduate, Innovator Founder, Global Talent or a sponsored route where genuinely available.

Clear scope, controlled information and an intact professional relationship.

01

Determine who is affected.

Separate the institutional sponsor question, the individual student's position and any adviser or representative involved in the referral.

02

Identify the governing material.

Confirm the current student sponsor guidance, relevant Immigration Rules, provider data and any Home Office correspondence.

03

Define the legal issue.

Distinguish strategic sponsor advice, an individual immigration application, a compliance concern and any proposed graduate or founder transition.

04

Coordinate the response.

Align legal advice with admissions, compliance and existing institutional counsel while maintaining confidentiality and appropriate professional boundaries.

Points to establish before an introduction.

01Does a university offer guarantee that a Student visa will be granted?+

No. Admission and immigration permission are separate decisions. A student must satisfy the relevant Immigration Rules, and the provider must meet its own sponsor duties.

02Can a university issue a CAS without considering its wider sponsor compliance position?+

A CAS should be considered within the institution's sponsor duties, admissions controls, current guidance and the facts of the individual case.

03Does a Graduate visa automatically allow every family member to join the applicant?+

No. Dependant eligibility depends on the applicant's existing permission, the dependant's circumstances and the applicable Immigration Rules. A child born in the UK can raise a separate analysis.

04Can an education adviser promise a founder endorsement after graduation?+

No. Endorsement requires an authorised endorsing body and an eligible, evidence based business proposition. Route selection must reflect the graduate's actual circumstances.

Applications, sponsored roles, reporting, payroll and inspection readiness form one regulatory system. Continue with the part of that system that determines the present risk.
