Continued employment and the next immigration decision require separate answers.
Current sponsor guidance, including Part 3 C9.19 to C9.21 and Part 2 S9.22 to S9.23. This is an analysis of existing suspension controls, not an announcement of new settlement law.
The position
What happens to a Skilled Worker's extension or ILR application during suspension?
Suspension does not by itself stop an existing sponsored employee from working under their current permission. The sponsor cannot assign a new Certificate of Sponsorship while suspended. Home Office guidance says an application supported by a valid CoS assigned before suspension, or a sponsor-supported ILR application, will normally await resolution of the suspension; it may still be refused on other grounds. Suspension does not extend the worker's visa.
- An assigned certificate and unused allocation are different: only the former may support an application.
- Permission expiry and any section 3C protection must be assessed separately for each person.
- Revocation is a different event with materially different consequences.
The suspension letter arrives while the employer is preparing an extension for a critical employee. Another employee has already applied for settlement. Both ask whether they should stop working. HR asks whether buying priority processing will resolve the problem. The licence response is urgent, but it is only 1 part of the instruction.
The governing distinction is between an existing permission, a certificate capable of supporting a future application and the Home Office's willingness to decide that application. A business can have continuing employment rights on the first question and a serious obstacle on the second or third. A general reassurance that everyone can carry on does not manage the expiry risk.
01 / Board control
Run the licence response and the workforce timetable in parallel.
The useful first document is a confidential workforce schedule: current permission, expiry, actual sponsored role, CoS assignment date, pending application, planned travel and affected dependants. Give each case an owner and a next decision date. Keep this separate from the employer's evidence addressing the alleged breaches, while ensuring the 2 records agree.
Prioritisation by seniority alone is unsafe. An employee whose permission expires soon may need attention before a director with several years remaining. A settlement applicant may face a different exposure from a colleague who already holds settlement. Identify those differences before sending a collective staff announcement or promising a resolution date.
The board should commission 2 deliverables: the licence defence and a continuity plan if the suspension remains unresolved. Neither document substitutes for the other. This approach is practitioner judgment about managing the instruction; it is not a separate Home Office procedure or a guarantee that a licence will be restored.
02 / Existing permission
Do not equate suspension with immediate loss of the right to work.
GOV.UK's employee guidance distinguishes suspension from loss of the licence. It says a worker already working can continue and a worker who has travelled to the UK but has not started can start. That reassurance concerns suspension; it does not remove the need to check the person's permission, conditions and expiry or any individual cancellation decision.
HR should preserve the prescribed right to work evidence and diarise any repeat check. An assurance from management about the licence is not a substitute for the employee's status evidence. Nor should suspension be used as a reason to discard ordinary payroll, role and attendance controls: those records may be central to both the defence and an employee's later application.
03 / Extension evidence
A CoS assigned before suspension is different from a plan to assign one.
Part 3 C9.19 prevents assignment of any CoS during suspension. C9.20 separately addresses applications supported by a valid certificate assigned before suspension: the Home Office will hold the decision until the suspension issue is resolved, unless another refusal ground applies. A draft CoS or an available allocation is not an assigned certificate.
Obtain the actual certificate and assignment record. Check its continuing validity and the proposed application against the current Skilled Worker Rules. Do not assume an earlier assignment makes the job, salary or application timing compliant. Equally, do not tell an employee that an existing valid certificate is automatically unusable merely because the licence was subsequently suspended.
This distinction should shape the advice before expiry. One employee may have an application capable of being made on the existing record; another may lack the necessary sponsorship evidence. A payroll team's intention to renew both workers does not place them in the same legal position.
04 / Personal deadline
The employer's representations do not extend anyone's visa.
An unresolved suspension is not a statutory extension of immigration permission. A worker approaching expiry needs individual advice on a valid application, the available route and evidence, and what happens if the required CoS cannot be assigned. A letter to the sponsor team, a proposed defence or a request for urgency is not the worker's immigration application.
Section 3C can continue existing leave after expiry where its requirements are met through an in-time application. It normally preserves existing conditions rather than conferring permission for a different job. Validity, withdrawal, variation, travel and any later decision can change the answer. Do not recommend an unsupported application simply as a device to buy time or assume that paying a fee establishes continuing status.
For illustration, consider 2 employees whose visas expire in 4 weeks. One has a valid extension CoS assigned before suspension; the other has only an unassigned draft. Their employer may be pursuing the same licence defence, but each employee needs a separate application and work-rights assessment. This is a hypothetical planning example, not a reported client outcome.
05 / ILR exposure
An ILR application does not insulate the worker from the sponsor's case.
Part 2 S9.22 expressly holds a sponsored worker's settlement decision while the suspension is unresolved. S9.23 states that revocation before the settlement decision leads to refusal. Submitting the application therefore does not remove the sponsor-related dependency. The employer should identify settlement applicants early rather than treating them as already outside the risk.
Appendix Skilled Worker contains its own settlement requirements, including the sponsor, continuing employment and salary provisions. Reaching the qualifying residence period is not enough by itself. The employment confirmation should reflect the actual position; it should not promise a role or remuneration the employer cannot substantiate.
For an employee weighing continued sponsorship against another employer, review the pending application, proposed role and timing before taking action. A new employer may offer a viable contingency, but changing employment is not an automatic cure for a pending ILR case. The correct sequence depends on the current Rules and the individual's application history.
06 / Advice and confidentiality
The company's objective and the employee's objective may diverge.
The employer wants reinstatement and retention. An employee may need independent advice about another sponsor, travel, a partner's application or personal disclosures. Define whom the adviser represents, what may be shared and whether a conflict prevents a joint instruction. The company should not require a worker to forgo personal advice in order to demonstrate confidence in the licence defence.
A useful employee communication states what has happened, what remains permitted on verified information, what is uncertain and who will review individual deadlines. Avoid describing suspension as revocation, giving everyone a supposed automatic 60 days, or suggesting that a pending application guarantees settlement. Keep the employer's confidential defence separate from information each worker needs to protect their position.
07 / Exit from suspension
Plan for the decision rather than assuming reinstatement.
The Home Office may reinstate or revoke a suspended licence, and reinstatement may involve restrictions or a changed rating. Read the actual decision and permitted functions before restarting assignments or confirming start dates. A favourable headline does not establish that every outstanding worker application is complete or will succeed.
For employees abroad with entry clearance granted on a pre-suspension CoS, C9.21 permits entry and commencement provided revocation has not occurred before travel. Check the actual licence and permission position before departure. For someone already in the UK with a pending application, obtain advice before travel rather than treating that entry-clearance provision as permission to leave and return.
Agree escalation points at the outset: an approaching personal expiry, a refusal, revocation, a change in employment or a proposed trip. Record the next step for each scenario. Counsel's contribution is to turn those events into decisions the business and worker can take on evidence, while preserving the independence of each person's advice.
Workforce decision framework
Classify each case before giving collective reassurance.
Start with the immigration record and the actual suspension letter.
Read the permission
Confirm conditions, expiry and any individual decision.
Verify assignment
Distinguish a valid assigned CoS from allocation or a draft.
Map applications
Separate extensions, settlement, entry clearance and dependants.
Protect deadlines
Assess application validity, section 3C and work evidence individually.
Agree contingencies
Allocate advice and decisions for delay, reinstatement or revocation.
Practical questions.
Can I keep working if my sponsor licence is suspended?
Suspension alone does not stop an existing sponsored employee working under current permission. Check expiry, conditions and any individual decision separately.
Can the employer issue a CoS during suspension?
No. Part 3 C9.19 prevents CoS assignment during suspension. An existing valid CoS assigned beforehand requires separate assessment.
Will priority processing overcome a sponsor suspension?
Do not assume so. Paying for priority does not displace the published policy to hold affected applications while the suspension issue remains unresolved.
Does an ILR application protect me if the licence is revoked?
No. Part 2 S9.23 says a sponsored worker's settlement application will be refused if revocation occurs before its decision. Obtain individual advice urgently.

A credible suspension response protects the licence and identifies every worker whose next decision cannot wait for the employer's case to conclude. Continued work, extension evidence and settlement prospects must each be verified on their own terms.
