Current Rules and guidance · Checked 21 October 2026
A pending application is not a general permission to start sponsored work.
This analysis applies the current Student work conditions and Skilled Worker sponsor guidance. It distinguishes permission to switch, permission to work before decision and the prescribed right-to-work check. The exception does not apply merely because a Certificate of Sponsorship has been assigned.
The position
An eligible Student can start the permanent job after a valid application, but the exception is conditional
A Student can sometimes start the full-time permanent role before the Skilled Worker decision. They must make a valid in-country Skilled Worker application while holding Student permission, be studying an eligible full-time degree-level course with a compliant higher education provider, apply no more than 3 months before course completion, and have a Certificate of Sponsorship start date no earlier than completion. If they start before completing the course, they remain limited to 20 hours a week until completion. The employer must complete the appropriate right-to-work check before work begins.
- A CoS, job offer or application payment alone is not enough: the Skilled Worker application must be valid.
- A person applying from overseas, or switching from a route whose existing conditions do not permit the work, normally waits for the grant.
- If refusal and any administrative review become final, the Student exception ends; the employer must reassess work and sponsorship immediately.
A graduate has finished examinations, the employer has assigned a Certificate of Sponsorship and both sides want the sponsored role to begin. The immigration application is pending. One answer says a Student cannot fill a permanent vacancy; another says work may begin as soon as the application is submitted. Neither is safe without the conditions which connect those propositions.
The Rules contain a narrow exception to the ordinary Student work restriction. It can be commercially valuable: the employer need not always postpone the start until the Skilled Worker decision. But the exception depends upon the course, provider, application date, CoS start date, continuing application and actual hours worked. An error at any one of those points can become an illegal-working issue as well as an immigration problem for the graduate.
The practical decision therefore has 3 stages. First establish that the person can switch in-country. Then establish whether their existing Student conditions permit this permanent role while the application is pending. Finally, carry out and retain the prescribed right-to-work check. A successful answer at one stage does not replace the others.
01 / Separate the tests
Switching eligibility, interim work and the employer’s statutory excuse are different questions.
Appendix Skilled Worker controls whether the applicant may switch from Student permission. Appendix Student ST 26 controls what the person may do while Student conditions continue. The right-to-work regime controls the check by which the employer establishes and records the permission to do the proposed work. Passing the Skilled Worker eligibility test does not itself prove a lawful start date.
A sponsor may therefore have a credible occupation code, salary and CoS yet still start the worker too early. Conversely, a Student may be within the work exception while the employer has not completed the check needed for a statutory excuse. The recruitment file should record a conclusion on all 3 questions rather than a single note that the visa was submitted.
The analysis is also role-specific. Permission to undertake limited Student work, a temporary internship or an existing part-time role does not automatically permit the new full-time permanent vacancy. The proposed duties, hours and contract must be tested against the permission actually held on the start date.
02 / Permission to switch
The course and CoS dates must first permit an in-country Skilled Worker application.
The current sponsor guidance, reflecting Appendix Skilled Worker, gives 3 relevant pathways for a person who has or last had Student permission. They may have completed the sponsored course; they may be on a full-time degree-level course with a higher education provider with a track record of compliance and have a CoS start date no earlier than course completion; or they may be at least 24 months into an eligible full-time PhD with a compliant provider and have a CoS start date no earlier than that point.
Those alternatives decide whether an in-country switch is available. They should be evidenced from the CAS and provider record, not inferred from a graduation ceremony or the last examination. The provider’s qualifying status can be checked against the register of Student sponsors. A course described informally as postgraduate is not enough if the sponsor, level or study mode does not satisfy the Rule.
Where the applicant received government or international scholarship support covering both fees and living costs during the relevant 12-month period, written sponsor consent may be a validity requirement. That issue should be resolved before treating an online submission as the valid application on which early work depends.
03 / ST 26.6
The permanent-vacancy exception begins with a valid application, not the CoS assignment.
ST 26.6 permits a Student who makes a valid application for permission as a Skilled Worker to start employment in a full-time permanent vacancy up to 3 months before the course completion date. The Student must be studying a full-time degree-level course with a higher education provider which has a track record of compliance, the application must have been made while the person held Student permission, and the application or any qualifying administrative review must remain undecided.
The Skilled Worker sponsor guidance states the operational conditions more expressly: the application must be made before Student permission expires and no more than 3 months before course completion, while the CoS start date must be no earlier than course completion. This creates a deliberate distinction between the contractual work which may begin under Student conditions and the sponsored start date recorded on the CoS.
Do not use the date on which the CoS was assigned, the immigration fee was paid or documents were uploaded as a proxy for a valid application. Record the actual application date and retain evidence of submission and validity. If the application is rejected as invalid, there may never have been the application required by ST 26.6.
04 / The hours limit
Starting the permanent role before completion does not permit full-time hours before completion.
The phrase ‘start employment in a full-time permanent vacancy’ describes the type of vacancy the Student may enter. It does not remove the separate limit on hours before studies are complete. Sponsor guidance SK3.31 says that a Student who makes the valid Skilled Worker application while still studying remains limited to a maximum of 20 hours a week until they have completed their studies.
The employer should therefore identify 2 dates where the application is made before course completion: the earliest lawful date on which the employment relationship may begin, and the date on which the hours can increase after completion. Payroll, rota, time-recording and line-management instructions should reflect that distinction. Calling the pre-completion period training does not take working time outside the condition if productive work is being performed.
After course completion, the sponsor guidance example permits the eligible Student to start the permanent role as soon as the valid application has been made, even though the Skilled Worker decision and the later CoS start date remain outstanding. Evidence of the official course completion date should be retained because term dates, dissertation submission and award dates can differ.
05 / The employer check
The immigration analysis must be converted into a prescribed right-to-work check.
Before employment begins, the employer must carry out the prescribed check appropriate to the worker’s status. A share code and the Home Office online service may establish the current permission and its restrictions. Where the outstanding application cannot be confirmed through the online service and the employer is reasonably satisfied that it was made before the previous permission expired, current Home Office guidance directs the employer to obtain a Positive Verification Notice through the Employer Checking Service.
A receipt from the applicant’s solicitor, an application screenshot or the sponsor’s own CoS record is not a prescribed right-to-work check. Those documents may help establish the chronology, but they do not replace the Home Office process. Retain the required record securely for the statutory period and diarise any follow-up check indicated by the online result or Positive Verification Notice.
The check must answer the proposed work. If the result still records Student conditions, the employer should document why ST 26.6 permits this permanent vacancy, verify course completion for full-time hours, and avoid expanding the role beyond the condition established. Immigration advice on the exception and the statutory check are complementary controls.
06 / Do not generalise
Most applicants cannot rely on the Student exception.
Sponsor guidance states the general rule: a person switching to a sponsored work route must not start the sponsored employment until the application is granted unless their existing permission already allows the work. A dependant with unrestricted work rights may be in a materially different position from a Student. A Visitor or a person applying from overseas cannot rely on ST 26.6.
A Graduate permission holder can generally work in the proposed role under the conditions of that existing permission while a Skilled Worker application is pending. That is not an application of the Student exception and the right-to-work check should identify the permission actually relied upon. A person whose Student permission expired before a late application requires a separate status and validity analysis; early work should not be assumed.
The Graduate route also has its own Student-stage rule for beginning a permanent vacancy once the course has been successfully completed and a valid Graduate application is pending. Employers should not borrow that completion test for a Skilled Worker application, which uses the distinct 3-month and CoS conditions set out above.
07 / A decision changes the basis
Refusal, invalidity, withdrawal and administrative review require immediate control.
ST 26.6 can continue while the Skilled Worker application remains undecided and, after refusal, while a qualifying administrative review has not been finally determined. That does not make every challenge effective or preserve work indefinitely. Confirm that administrative review is available, validly filed and still pending before relying upon that limb of the Rule.
Sponsor guidance requires the sponsor to stop sponsoring the person if the application is eventually refused and any administrative review is finally dismissed. Continued employment then requires another existing permission which independently permits the work. The employer should assign ownership for monitoring the decision and escalation on the day it is received rather than wait for a scheduled follow-up check.
Withdrawal, travel while an in-country application is pending, or a notice that the application is invalid can also change the foundation for work. The employee should disclose relevant Home Office correspondence promptly under an agreed process. The employer should respond to the actual event and obtain advice, not impose a blanket assumption that every delay or request for information ends the right to work.
08 / Recruitment control
Approve the start only when the dates tell one coherent story.
A useful start-date approval records the Student permission expiry, provider and course level, completion date, application date, CoS start date, expected hours before and after completion, right-to-work evidence and owner for decision monitoring. It should also identify any government sponsorship consent and any fact which could make the application invalid.
The contract can be conditional on the continuing right to work while still recognising an earlier lawful start under Student conditions. The sponsor should avoid drafting a CoS start date earlier than the course completion date merely to match payroll. If a commercial deadline falls outside the exception, the answer is to move the start or obtain the Skilled Worker decision, not to relabel the vacancy.
For graduate recruitment programmes, incorporate the control into offer templates, HR onboarding and sponsor sign-off. The highest-risk failure is often not a difficult Rule but a handoff: immigration approves sponsorship, recruitment agrees a date, and payroll assumes that approval already means unrestricted work.
Employer start-date framework
Clear the role through 7 gates before the Student begins.
This is a practical control sequence, not an additional set of Immigration Rules. It connects the switching requirements, Student conditions and the employer’s checking duty.
Verify the course
Confirm full-time degree-level study, the qualifying provider and the official completion date.
Check switching eligibility
Apply the completed-course, degree-course or PhD condition and identify any scholarship consent.
Align the CoS
Keep the sponsored start date no earlier than course completion and verify the sponsored role itself.
Establish a valid application
Record filing before Student permission expires and no more than 3 months before completion where the exception is relied upon.
Set the hours
Limit work to 20 hours a week until completion, then document the move to full-time hours.
Complete the prescribed check
Use the online service or Employer Checking Service as applicable and retain the evidence and follow-up date.
Monitor the decision
Escalate invalidity, refusal, review, withdrawal or other change before sponsorship or employment continues.
Practical questions.
Can an international Student start a Skilled Worker job while the visa is pending?
Sometimes. ST 26.6 permits an eligible Student to enter a full-time permanent vacancy after making a valid Skilled Worker application, subject to the qualifying course and provider, the 3-month application window, a CoS start date no earlier than completion and the continuing application. The employer must complete the appropriate right-to-work check.
Can the Student work full-time before finishing the course?
No under this exception. Sponsor guidance states that a Student who applies while still studying remains limited to a maximum of 20 hours a week until completing the studies, even though they may enter the permanent vacancy.
Does assigning a Certificate of Sponsorship allow the person to start?
No. The exception requires a valid Skilled Worker application and all other conditions. The CoS start date must be no earlier than course completion, and the employer still needs a prescribed right-to-work check.
What evidence should the employer retain?
Keep the prescribed right-to-work check, the application and Student permission chronology, course and provider evidence, completion date, CoS details, working-hours control and any required Positive Verification Notice. The exact statutory retention requirements in current Home Office guidance should be followed.
What happens if the Skilled Worker application is refused?
The exception can continue while an available administrative review is validly pending, but ends when the application and any qualifying review are finally determined. The sponsor and employer must then stop unless another valid permission independently allows the work.
Can someone applying from outside the UK start before the visa is granted?
No. ST 26.6 concerns an eligible Student making a permission-to-stay application in the UK. An overseas applicant must obtain entry clearance before travelling to take up the sponsored role.

The useful answer is not simply ‘yes, once submitted’. It is that an eligible Student may enter the permanent role only when the course, application, CoS, hours and right-to-work evidence all support the same start date. The exception rewards careful sequencing; it does not excuse it.
