Business mobility · Visitor boundaries

You can sign the UK contract. Can you stay to deliver it?

The meeting becomes a workshop. The workshop becomes implementation. A legitimate sales visit can become an immigration problem when the commercial timetable changes faster than the travel permission.

Visitor Rules · Current permitted activities

The activity matters more than the label on the itinerary.

This analysis concerns ordinary commercial visits. Specific professional and sector permissions must be checked separately where relevant.

The position

Can a business visitor deliver a contract signed in the UK?

Not automatically. Visitors may negotiate and sign contracts, but that does not provide general permission to perform the resulting UK work. Overseas payment, a short trip or an ETA does not cure an activity outside the visitor conditions. Some defined activities, including qualifying intra-group work and installation of supplied software, may be permitted; the actual tasks and contractual structure must satisfy the relevant exception.

A founder arrives for a final customer meeting. The contract is signed and the customer asks the founder to remain for a week to configure the service with its team. The commercial response may be straightforward. The immigration response requires a new assessment of what will happen in the UK.

The recurring mistake is to classify the traveller rather than the work. Business visitor is used as though it described a professional who may conduct any short business activity. In practice, a single itinerary can contain both permitted meetings and tasks requiring a different immigration route.

01 · The boundary

A customer briefing is different from carrying out the customer's work.

PA 4 permits contract negotiation and signing. It also permits a visitor to receive a briefing on a UK customer's requirements where the resulting work is done outside the UK. The permission should be read against the proposed deliverables, not just the meeting invitation.

In an illustrative software engagement, a session to understand a prospective customer's requirements raises a different question from a session producing its configured workflow or migrating its data. Calling both sessions discovery does not remove the difference. Determine what the customer will receive at the end of the visit and who is responsible for producing it.

A useful control is to review the statement of work alongside the daily agenda. Sales teams often know the agenda; delivery teams know the actual commitment. Immigration advice needs both. If the scope changes after signature, travel approval should be revisited before the additional work begins.

02 · The misconception

Being paid abroad does not authorise the UK activity.

Appendix V prohibits work except where expressly permitted. That includes work for a UK organisation and the provision of goods or services. The separate restrictions and exceptions concerning payment do not create a general right to work simply because remuneration remains overseas.

Keep 2 questions separate in the review: is the activity permitted, and is the payment arrangement consistent with the visitor conditions? An overseas payroll may explain the employment relationship. It does not answer the first question.

The same distinction applies to an owner who takes no salary for the visit. A founder's willingness to perform the work without personal payment does not convert commercial delivery into tourism or a meeting. The substance of the service still needs to be classified.

03 · Specific permissions

Installation and group projects require their own analysis.

PA 7 can permit qualifying employees of an overseas manufacturer or supplier to install or service supplied software, hardware or equipment. It also addresses certain after-sales contractual arrangements. PA 5 separately addresses specified activities within a corporate group and imposes conditions on client-facing activity. Neither provision is a general consultancy exemption.

For a proposed software implementation, obtain the supply contract and identify the overseas employer's role before assuming PA 7 applies. For a group assignment, identify which group entity owes the client the service and what the visiting employee will actually do. The contractual chain can change the analysis.

Do not stretch an exception to fit a journey that has already been booked. If the structure falls outside it, assess an appropriate work route and its requirements. The commercially useful advice may be to alter the delivery location or timing, rather than to search for a more accommodating description of the same work.

04 · Remote work

A laptop does not move the worker outside the UK.

PA 4(h) allows remote activities relating to overseas employment where they are not the visit's primary purpose. It does not establish a general remote working route. Consider the real reason for the stay and the planned activity, not merely the location of the server or employer.

Answering occasional overseas work queries during a permitted visit presents a different factual picture from travelling to the UK to perform a full delivery schedule online. The invitation, calendar, accommodation period and contractual deadlines should tell a coherent story.

Where a customer expects the traveller to be available throughout a UK working week, examine that expectation before relying on incidental remote work. The aim is to establish a compliant plan in advance, rather than manufacture an explanation at the border.

05 · Commercial control

Approve activities, not a reusable business-travel label.

The approval record should identify the traveller, overseas role, UK counterparties, tasks, deliverables, payment arrangements and the permission relied on. Include a clear process for scope changes. A customer asking for additional work should trigger a review rather than an assumption that the existing trip approval still applies.

An ETA is permission to travel, not a work permission or a guarantee of admission. A visit visa also leaves the traveller subject to visitor conditions. Frequent visits require separate attention to whether the individual is effectively living in the UK through repeated stays; there is no general annual allowance that resolves every pattern.

For businesses selling into the UK, this is a delivery governance issue. Sales promises, staffing plans and immigration permission should be reconciled before the contract fixes an implementation date. A legally sound travel plan is more useful than a carefully drafted invitation describing work the traveller is not permitted to perform.

Before approving the trip

Review the commercial substance in 5 steps.

Use the actual contract and work plan rather than a generic invitation template.

01

List the tasks

Separate negotiations, information gathering, training, installation and productive delivery.

02

Identify the parties

Record who employs the traveller, supplies the product and owes the customer the service.

03

Find the permission

Match each task to a precise visitor provision or assess the need for a work route.

04

Check the whole visit

Review payment, primary purpose, duration, travel history and intended departure.

05

Control changes

Require a fresh review if the customer asks for additional implementation or an extended stay.

Practical questions.

Does an ETA allow me to work on a UK customer project?

An ETA does not provide a general right to work. The proposed activity must be permitted under the conditions of entry or authorised by an appropriate work route.

Can overseas payment make an otherwise prohibited activity permissible?

No. Activity and payment must each comply with the visitor framework.

Can software installation ever be permitted for a visitor?

Yes, PA 7 contains a specific permission subject to conditions concerning the overseas company, supply arrangement and activity. It should be checked against the actual contract.

Permission to conclude the deal should never be treated as permission to carry it out. Review the deliverables before the traveller becomes part of them.

Follow the sponsor position from licence to continuing control.

Applications, sponsored roles, reporting, payroll and inspection readiness form one regulatory system. Continue with the part of that system that determines the present risk.
