Undefined CoS allocation delayed: what if the worker's visa is expiring?

An allocation request belongs to the sponsor. The immigration deadline belongs to the worker. A credible retention plan must manage both before the available time disappears.

A sponsor request does not extend the worker's permission.

Current published procedure and Immigration Rules. Processing periods are service expectations, not guaranteed outcomes or extensions of immigration status.

The position

Does a pending CoS allocation request protect the worker's visa?

No. An employer's request for extra Undefined Certificates of Sponsorship does not extend a worker's permission. Check the available allocation, request status and post licence priority eligibility immediately, while obtaining separate advice on a valid application before permission expires. A priority request, an allocation approval and an assigned CoS are each different from the worker making an immigration application.

  • Undefined CoS are used for in-country Skilled Worker applications; Defined CoS are for Skilled Worker entry clearance.
  • Do not assume that an unaccepted priority request has started a 5 working day clock.
  • Section 3C protection and permission to work depend on the worker's own application and existing conditions.

The employer has an A-rated licence, a continuing need for the employee and an intention to renew sponsorship. The SMS account nevertheless shows no available Undefined CoS. The employee's permission expires shortly. At that point the question is no longer simply how quickly UKVI can increase the allocation. It is whether the business has a workable retention plan if it does not.

The dangerous misconception is that an official request somewhere in the system protects everyone while the Home Office considers it. The sponsor and worker are taking different legal steps. Treating them as one process can turn an administrative delay into a personal status problem and a workforce interruption.

01 / Identify the missing step

An empty allocation is different from an unassigned certificate.

Obtain the actual SMS record, rather than a message saying that the CoS is pending. Confirm the licence route and rating, allocation balance, CoS year, outstanding request reference and whether a certificate has already been assigned. A draft marked ready to go has not yet been assigned. Allocation approval gives the sponsor capacity to assign; it does not complete assignment to the named worker.

For an in-country Skilled Worker application, check the Undefined allocation. A Defined CoS request is not a faster substitute. The application location determines the category. Nor can a certificate from another group company simply be borrowed because the companies share owners. The legal sponsor and employment structure must be correct.

02 / Test the available procedure

Priority is an application for consideration, not a reservation of an outcome.

GOV.UK gives a usual period of up to 12 weeks for an extra Undefined allocation, with additional checks potentially taking longer. The post licence priority service covers eligible Undefined allocation requests. It requires a fully active A-rated sponsor, an SMS request already submitted and a request not already in progress or allocated to a caseworker. Defined CoS requests are excluded from this service.

The published service charges £350 per request and operates on working weekdays, subject to capacity. Follow the current form and instructions rather than historic slot advice. Acceptance and payment matter: the normal 5 working day consideration period starts on the working day after payment, subject to the guidance's qualifications. Extra checks or complexity can delay the outcome. Neither payment nor priority guarantees approval.

The operational task is to establish where the request actually sits. Keep the SMS submission, priority correspondence, payment confirmation and requests for further information in one file. Ask for a reasoned urgent review through the appropriate published channel where justified, supported by the real expiry date and business evidence. Do not present an escalation email as an accepted priority application or promise that urgency creates an entitlement to expedition.

03 / Make the request decision-ready

Urgency explains the timetable. It does not prove the recruitment need.

A useful instruction separates the number of certificates requested from the evidence for each proposed use. Identify extensions, switches and new hires; the roles, occupation codes, salary and hours; intended dates; and the relevant current permissions. Reconcile the request with the organisation's size, activity and ability to employ the proposed workers. Keep any sector-specific restrictions in view.

For retention, supply a clear account of the continuing job and the worker's existing sponsorship history. For expansion, explain the genuine business requirement without inflating headcount to create a buffer. Check the applicable Rules and transitional provisions for each worker before relying on last year's salary or eligibility assessment. An allocation decision does not certify that every proposed worker application will succeed.

04 / Protect the separate deadline

Section 3C is not triggered by the sponsor's SMS request.

Section 3C concerns a qualifying application to vary the person's leave made before it expires, with the statutory conditions satisfied. It does not arise because the employer is waiting for UKVI. SW 1.2(d) requires a CoS issued within the applicable period before application: ordinarily 3 months, with a separate 90-day provision and specified review-day disregard where linked to a Sponsorship Reference Number. Check the actual record against the current wording. A saved online form is not a submitted application; submitting a form does not by itself establish that the application is valid.

If the certificate cannot be assigned in time, obtain individual advice immediately on the application position, any applicable validation procedure and any genuinely available alternative route. Do not file a speculative placeholder using a false reference or assume a later certificate will cure every defect. Equally, do not abandon a potentially available lawful option without examining the actual facts and current guidance. The recommendation should identify its legal basis and uncertainty in writing before expiry.

Where section 3C does apply, it normally continues the existing conditions; it does not automatically authorise a new sponsored job. A same-sponsor extension and a move from another employer therefore require different workforce decisions. Verify the right to work through the prescribed process, using the Employer Checking Service where appropriate. An allocation acknowledgement is not right to work evidence.

05 / Decide before the last working day

The business needs a contingency that does not depend on silence meaning approval.

Consider a hypothetical employer with an allocation request outstanding and an employee whose permission expires in 3 weeks. The immediate control is a joint sponsor and worker review that day, not a diary reminder on the expiry date. Someone must own the request, someone must own the individual's advice, and HR must know when the position has to be reassessed.

Model what happens if priority is unavailable, more evidence is requested or the decision arrives after the employee's deadline. Identify the lawful work position, any necessary interruption, alternative operational cover and the consequences of any proposed departure and overseas application. Leaving the UK is not an administrative shortcut: it can change the application, return-to-work and family plan. Advice to the worker and advice to the employer may also require separate engagement and conflict consideration.

The longer term correction is to forecast certificates against actual expiry dates and hiring plans. The annual allocation review should precede the recruitment commitment. Keep an escalation point comfortably before the application window becomes urgent, and review the balance whenever hiring assumptions change. This is a governance control with a direct retention value.

06 / A defined instruction

Ask for a coordinated sponsor and worker assessment.

Jayesh can review the allocation record, request evidence and priority eligibility alongside the worker's current permission and filing options. Quastels can scope an urgent instruction covering the sponsor representation, application strategy, right to work implications and workforce contingency, with responsibilities and decision dates recorded clearly.

Start with the licence details, SMS screenshots and request reference, all UKVI correspondence, allocation history, proposed CoS information, job and salary evidence, and the worker's grants and expiry date. Provide any pending application details and planned travel. Work begins subject to conflicts, client checks and agreed scope and fees. No allocation, expedited decision or immigration outcome is guaranteed.

Decision framework

Run 2 workstreams against 1 deadline.

Test eligibility, acceptance and the actual consideration clock.

04

Advise

Resolve application validity, expiry and work conditions separately.

05

Contingency

Record the decision point and lawful operational alternative.

Practical questions.

Can we use a Defined CoS for an employee applying inside the UK?

No. Skilled Workers applying for permission to stay use an Undefined CoS. Do not substitute the overseas category to avoid an allocation delay.

Does paying for priority guarantee an allocation within 5 working days?

No. Published guidance describes consideration within that period for eligible accepted paid requests, subject to additional checks or complexity. Approval is not guaranteed.

Can the employee keep working because the allocation request is pending?

The request itself confers no immigration permission or work rights. Review existing permission, any valid in-time application, continued conditions and the employer's right to work evidence separately.

The critical question is whether the worker and business have a legally supported plan before permission expires. A sponsor request is one dependency in that plan. It should never be mistaken for the plan itself.

Follow the sponsor position from licence to continuing control.

Applications, sponsored roles, reporting, payroll and inspection readiness form one regulatory system. Continue with the part of that system that determines the present risk.
